It's actually kind of funny. Billy was upfront about what the lawsuit was about since the very beginning. His response video to Karl was entirely about the Apollo statements. At a con, he mentioned that the complaint had nothing to do with video games (Karl said this was wrong, even). This is legitimately the one case where Billy has been honest the whole time and Karl is the liar. It wasn't that hard to find out what the lawsuit was about, but Karl could have at least mentioned it. His argument is that it might have hurt him in court, which is funny when you're posting 20 Billy videos anyway. Saying "yeah, the lawsuit is about me saying Billy led Apollo to kill himself because I saw a Reddit post about it" isn't too great, I agree. But when you put it like that, he should have known he was doomed from the start. At the very least, he could have clarified that it wasn't about the cheating allegations.

Billy never had the reach and no matter what he said, it was not picked up by the mob of Youtube Drama Tubers.
There is also a significant difference between "Billy says he is doing X" and then being presented with a different narrative by the Youtuber you are subscribed to.
Billy was practically screaming it at every opportunity and I admit I did not take him seriously, because I falsely believed that Karl would not be retarded enough to claim something he had no foundation for. I expect Karl to be able to defend that claim, either as being factually true or having a solid reason to believe it being true at the time.

Karl was unable to show either of those two things.

People have referred to this website and previous project by Jobst since like 2021 but no one has any archives beyond the internet archive link, I can't find a copy/archive of the email or PDF anywhere so far.

The judge didn't cite them in his spoken verdict, but instead cited - and quoted - 396 comments from the public calling Billy Mitchell a "murderer", "scumbag", etc. among other things in response to Karl Jobst's claim that he was the cause of Apollo Legend's death.

This appeal will be tough for Karl since anyone who isn't terminally online is going to have trouble even pretending to care about someone cheating in donkey kong or why someone reputation being bad from cheating in a video game is remotely equivalent to being called a "murderer" by karls fan.

So Karl is back to having to defend accusing Billy of causing ApolloLegends death despite: the financial settlement he claimed ApolloLegend was forced to pay didnt happen, ApolloLegend's own brother said Billy Mitchell was not to blame for the death, and ApolloLegend's video and suicide note did not mention Billy Mitchell at all, conversely the note opted to directly put the blame on Karl's speedrunning pals.

The judge might have disliked Karl after the full hearing and when writing this judgement, but it is based on some very simple facts and after reading those facts a lot of people dislike Karl too.

This was presented as evidence in court and the judge cites it in the judgement. Karl was on a crusade and he had a target.


The judge literally spells it out that Karl acted with "reckless indifference to the facts" and explained why he came to that conclusion. This has nothing to do with the judge "not liking him".


And during the trial Karl admitted he had NO KNOWLEDGE if the settlement did NOT contribute to the suicide and the judge correctly ponders how it would be possible for him to not have knowledge about that at this point in time, but DID have knowledge at the time he made the defamatory statement? (Carefully forgetting his contribution to the hit piece on Apollo Legend and the fact that other people were explicitly named by him as responsible)


And in regards to the Reddit comment being used as a source. Firstly, it was objected to by the plaintiff and the it was not admitted as evidence in the trial.


Then the judge explains that even if he HAD considered it as evidence, it would not have changed anything because a single person making that assertion was not proof and that Karl failed to contact Billy or his team for comment or confirmation. Thereby having no reasonable basis for his claim.
