In America "actual malice" doesn't actually mean actual malice, it merely means knowledge of falsity or reckless disregard for truth or falsity. In Australia, "malice" actually does more or less mean what it does in normal language, although the Australian judge did use the phrase "reckless disregard" for one section of the analysis.

That's because the language derives from old English common law that we share historically, although the language has grown to mean different things.

Since malice actually does mean malice to an Australian court, Jobst's bizarre and intense obsession with Mitchell was actually relevant, constituted "malice," and would defeat a number of affirmative defenses like "fair comment" and the like.

However, under both jurisdictions, Mitchell's claim would have jumped the hurdle, since Jobst, according to the judge's findings, did also in fact act not only with malice (in its normal plain language sense) but he also did act with "reckless disregard" for the truth or falsity of his statements, thus meeting the "actual malice" standard we use in the U.S.

The $50K was actually punitive damages because the judge found that Karl was an utter dick. And yes, he explicitly said he'd have ordered more if he'd been asked.

I can't really say for sure, but in the U.S. he'd be limited to what he asked for in his pleading.

However, he could cross-appeal on the general damages and argue he deserved more, i.e. the actual statutory maximum.

Pointed out Jobst lied but instead they kept sperging out about Billy Mitchell’s lawyers did something or whatever and the judge is an idiot.

Not sure what you mean by the same aggravated rate?

If he manages to get leave to appeal, he could end up having to pay Billy's legal costs for that as well. Billy's team will probably ask for security before any appeal goes ahead (although who knows if they would get it).
