Since this recently happened with Billy winning his, the difference here with Billy and Jirard is, the latter would have to allege that what Jobst and Mutahar have done was defamatory and also life ruining. This would get thrown out of court for the following reasons.

1. Charity Fraud was the biggest claim. As far as we can tell from the thread, there are still shady and suspicious acts going on with Open Hand (it's also been compared to Open Hands foundation in name, which is a totally different charity, so minding a missing S can make a difference.) There's nothing defamatory here.

2. The most "life ruining" aspect is Jirard hasn't had much video output, and losing his friends. Otherwise, losing his sponsors was due to the catastrophic events of the G4 revival, and Indie World was self shut down by him due to these incidents. Everything else that ex-communicated him is arbitrary.

3. The most that Jirard could even argue is that Jobst and Mutahar pressured him and put him in a panic to figure out something, but considering all the other things he's said that is incriminating (subs and merch sales to his twitch were meant for donations but were instead given to staff and devs for flights and catering as an example), it's going to be hard to find something that's truly "defamatory."

At the same time, it would be incredibly hilarious of Jirard accelerated the lawsuit procedure for sloppy Aussie seconds.

I'm a bit late, but it's worth mentioning that there's never been definitive proof that Billy cheated.
Thing is, you don't need proof that he cheated, just that the records didn't follow the rules, and we know for a fact that Billy didn't follow the rules (played on MAME, played on a modified cabinet).
Also, Billy's not like Todd Rogers where he's just some nobody who blatantly lied about his own skills. He's genuinely really damn good at these games and has proven so, such as when he streamed himself pulling off a perfect Pac-Man in 2019. He's not an awful guy, just a bit of a tool.

First he would have to prove that their claims war not true.
Which he can't for the raised money being still in the foundation's accounts at the time of their investigation.
And then he would also have to prove that all money during his fundraising marathon from bits and subscriptions was accurately recorded, logged as donations, and did not go into his company, because that is what he told viewers during those streams.

Unless he can prove both those things he can stuff this lawsuit up his ass.

I think the issue is that most of Karl's videos about Billy Mitchell were talking specifically about the Twin Galaxies lawsuit. In that one Billy's cheating actually was material to the case since Billy was being sued for fraud by the new owner who alleged that Billy Mitchell and Walter Day had misrepresented the TG score database' integrity, which of course is the only real asset of TG. Karl didn't do a good job of separating this lawsuit from his own, or intentionally conflated the two, when talking about Billy Mitchell and the two ended up being conflated to most viewers.

The one he forgot to post and the case he never really made a standalone video about is the one that remained in the end.

Even if you saw at some point that there was something about Karl, Apollo Legend and the accusation involving Billy, it did not mean automatically the other defamatory imputations were dropped (which they were at some point).

Was it possible to know that Billy had ALSO filed a lawsuit against Karl over the Apollo Legend claim? Absolutely. If you went actively looking instead of just consuming the videos Youtube recommended.

Was it easy to find the info that the other defamatory imputations, which were about cheating allegations, had been dropped by Billy? I am not sure if that was ever shared publicly, because I have no seen it and only found out when lawsuit was resolved.

The MAME debacle demonstrated that Billy was dishonest about what hardware he was using, but the actual difference is the difference between playing Goldeneye on N64 versus Nintendo Switch N64 app. It’s the same game, but there are some technical differences that only other pros at the game will perceive.
