Will Nicholas Rekieta take the plea deal offered to him?

this is a very lenient sentence for what he did

almost an ounce of blow with the whole his kids had access to it thing
they are setting him up for failure. he's gonna violate his probation, we all know it, the judge and prosecution know it. And there's no plea deal, no litigation or mitigation with a probation violation, one bang of the gavel and you're off to prison. It's also super hard to get parole cause you've already violated your probation, so they're gonna assume you'll just violate your parole as well.
 
He's going to violate probation and end up in jail. Not for the complete five years on the first violation, but he will end up going back to jail. He hasn't learned anything from this legal experience so far.
Probation officers will most likely allow him one or two fuckups before they have him hauled back to jail. Then again, Nick isn't known for being contrite so who knows.
 
What does "May be deferred of complaint with probation" mean?
It probably should say: "May be deferred if compliant with probation." Basically, if Nick is a good little cuck, and complies 100% with his PO, including allowing the PO to go in dry at any time, then Nick doesn't have to spend 28 days in the county lock-up.

From the stories I've been told, 100% depends on how much your probation officer hates you. I do not think Nick will be able to not be a complete faggot and piss off his probation officer.
 
30 days jail deferred was about what I expected, but 5 years probation? That was a surprise, I fully expected maybe a year at max.
He really pissed off the Judges, that's why. Nick got down on his hands and knees and begged them "please, my family, my family! It was just a phase! I'm clean now!", so the Judge (knowing full well who they were dealing with) said "Okay Balldo, we will take you at your word", while leaving a mile deep elephant trap for him, so there won't be a smug Rekieta talking smack about "winning" his case in a year; glass of whiskey in his effete hands.
 
Can someone with better memory reiterate that stuff Nick did during the start of his legal troubles? I forget the details but this guy was such a druggie that he paid a ton of money to ensure he can keep drinking and stuff.

That behaviour is why the probation is such a gut punch.

Nigga he is fucked. Smokes come up in a DARE class man. That is the standard he is being held to. No drinking, no smokes, no weed, nothing at all. He is going to be sober or off to the gulag he goes.
Things like ciggies, caffeine, and basic OTCs are not counted in any probation I’ve ever seen. I think it’s how they classify them, and I’ve never seen one barring someone from nicotine.

No, probation officers typically come down like the hammer of God on probation violators. If you don't show up for an appointment or they have strong reason to believe you're fucking around and probably in violation, they come looking for you right away and by they I mean both themselves and the local police or sheriff's department. This is impressed upon offenders at the first PO appointment. I've practically got that happy fun introductory speech memorized. I doubt it differs much from state to state.
