Magistrate Judge Bennett can't rule on it since District Court Judge Barlow made the call.

Bennett said "First Sanctions Approved, work with Greer" Hardin said: "LOL, Greer refused, here's the amount."
Barlow said: "LOL, $1000" (without likely reviewing Hardin's actual amount).
Bennett is now overruled and the amount Hardin sent is moot.

There are still more possible sanctions in play.


Makes sense. I thought it was something else because I thought they'd already agreed it couldn't be appealed, so I figured this was over new fees.

The Court has anticipated that Russ will screw around in bad faith. That's why the Hardship was ordered to give a report back to the Court on whether Russ complied with the order.
Here's hoping Hardin gives Russell a big fat F on his court-ordered report card.

Depends on the court. You can do check, cash, money order or credit card. Though the Courts really don't like Credit Cards since it involves having to pay the payment processor extra. So most of them require you to go to the clerks office in person and then make you sign a form saying you understand you will have to pay extra to pay with a credit card. Cash has to be in person too, obviously. If you do Check or Money order you can just mail it to the clerk.
 
"The check must have gotten lost in the mail" is a gambit as old as checks. What are the odds Rusty tries this as an excuse for not paying the filing fee?
If you aren't paying extra for certified mail with a tracking number on it, you are asking for trouble and the court don't care. Nothing stopping you from just withdrawing 4 benjamins and stopping by the office on the day if your payment hasn't posted. Judges are Lawyers too, and the one unforgivable sin to a lawyer is not getting paid.

If he has to deliver it to Utah by hand you know that money will be spent long before he gets there.
 
It's almost a certainty IMO, and then we have the hardest task of all - not archiving it on the farms, but instead laughing about it second hand.
This raises the question of whether putting it in a Google doc and linking to it here constitutes vicarious contempt of court under the 10th Circuit's interpretation of copyright law.
 
The only possible breach would be if Greer just randomly emails it to the clerk without marking and the clerk doesn't notice and just posts it to the docket.
I hope it is picked up by the clerk who has probably been entertaining friends and family with a running account of 'you won't believe what happened at work today'. In my head canon, this clerk has googled Rusty and is now a Kiwi. Thus the clerk accidentally on purpose dockets it.

I think one of a number of things is possible. Russell is:
1) Hunched over his bank app right now trying to bring himself around to transfer funds from his hooker fund, literally shaking and crying rn.
2) Going to approach the local Temple to pity beg
3) Calling his parents to fix his plights - it's always worked in the past.
4) Applying for a pay day loan (and getting knocked back).
5) Deciding not to pay a penny because when he wins the case it can be bundled in with the settlement Josh will have to pay him his. He will send a plightscreed to the court telling than that that's how it's going to be, buddy boy.*
6) A catatonic, rocking, drooling mess hunched over his phone, shades drawn, gazing at thots on Instagram.

*This is my bet. I know the money is owed to the court, however understanding this is a bridge too far for Rusty.

I find that out of all the mail, payment to the court always seems to make it intact.

I wish. man. At least in my area mail has went totally to shit ever since COVID and has never really recovered. I'm routinely having local mail get lost or take 10-14 days to make it to the other side of the metro area. If you wanna mail something to a rural area, good luck - maybe they'll have it in a month.

It's not like the entire world has developed instantaneous payment systems that even boomers can use. Maybe the court got debanked, did you think of that? Sheesh.

He's probably trying to figure out a motion to submit that'll defer it. It sort of worked deferring the March deadline for the $770-ish that he owes thanks sanctions right? He still hasn't paid that and no one has told him off for it, yet.

The Internet says the average food delivery is $6 in income or so. He needs 66 deliveries or so to cover the amount, it may take a while.
$770-ish that owed from sanctions right? He still hasn't paid that and no one has told him off for it, yet.
Presumably the defendants are just going to wait for the other $20-40k in sanctions before requesting they be paid.
