But would that stop him? I don't think that he's capable of that much forethought anymore.

And in my (limited) experience, people who like filing lawsuits tend to fire off the lawsuit first and worry about the potential cost later.
Since they can't know how long it'll go and how much it'll cost them before they start the process, it's kind of like gambling. Like every gambler, they're mostly just expecting to win, to the point that they're counting on winning (in terms of the lawsuit not costing them much). You wouldn't gamble if you thought that you were going to lose, right?
Their plans are always geared toward "this guy will get spooked and settle to give me what I want within a week or two," not "this is going to hit every complication possible, and it's going to drag on for years."
