That's not actually what the language says, although it is fairly sloppy form language (it refers to the requirement to upload items pre-hearing and adds in parens a note referring to these items as "exhibits" or "evidence," but the presumption in the form is that what is uploaded will survive the hearing as evidence; it doesn't talk about the status of things that aren't accepted by the Court as evidence (and likely doesn't need to, bc it's just a form and speaks to usual circumstances, not intended as a full exposition of the law). And what a form says doesn't change any formal rules. The MNDES guidance allows for the concept of removing certain items - so the questions are in what scenarios that applies, what is the status of items uploaded but not used, and did the uploads made pre-hearing for Nick's hearing meet those requirements for retention and availability to the public.

If the MNDES guidance misinterprets the legislative intent or improperly alters any established judicial concepts in allowing removal of such items from MNDES and availability that would otherwise be available, that's potentially a legal issue that the state really needs to clarify and resolve unequivocably. Would be interesting to know what has happened in other cases in Minnesota with withdrawn exhibits/ issues.

I don't know if it's so much as social understanding, as this weird psycho narcissist shit soup that flows in the brain of Nick and Ralph. Perhaps it's more this peculiar self hypnosis of ego. I think Nick perceives people as tools to get what he wants. (could also be a lack of available and or convenient options.)
