I don't think there will be much worth having. A lot of it has already been spent on Jonny. After selling the family home, I'm guessing mama bought her place outright and gave J a deposit for his and has been propping him up for years. It wouldn't surprise me if her place isn't loan secured out the wazoo. She and her sister are probably living on their government pensions.

Agree with everything in the post but surely Miriam's strata would already be working on ways to prevent that from happening this very moment.

Miriam owns that condo, so it will be super hard to get a court to agree to force her to sell it. They might banned Jonny but again, very hard to get a court to agree to that once he inherits it.

All in all I don't think there is much the strata can really do aside from start a long process of documenting and fining Jonny for all his infractions of the strata rules and after years maybe decades they can go to a judge with all that proof and even then they don't stand a good chance of winning.

I mean it's a good thing that a condo board can't really force an owner to sell just because they're assholes who everyone detests, even if that asshole tanks the property values for everyone else. Mortgage companies always do financial checks before making an offer.
I think it's highly unlikely that any company will make him a mortgage offer because of his current foreclosure situation.

Take a look at the case law on this; I covered it here. Based on reported decisions, it's not nearly as hard as I would have thought to force a sale.

Anecdotally I'm aware of this happening to people for nuisance-level behaviour.

Also, Yaniv cannot reside in that condo long term after she dies. He has to sell it unless she lives until he turns 55. That is enforceable; You cannot live in a 55+ building if you're under 55. He'd actually have a better case if she's alive, because he can claim to be her caregiver.

I duno...Jonny could go either way. He's a base coward who always takes the easiest route but at the same time he's a hate filled goblin who lives to cause pain to the world. So who knows, I take comfort in knowing that he will die and probably painfully when his stink ditch finally goes septic and he's got no one to help him, his 911 calls go unanswered because he's abused it so much and what poor animal he enslaves to be his service animal can only whimper quietly in the corner after years of abuse.

To clarify: He's paying the 13.9% interest rate because he didn't renew at 10.9%. 10.9% is still subprime but it only went into the absurd category when he stopped paying and didn't renew (when your mortgage is up for renewal you have the option to pay out or renew; You can't just keep paying at the old rate. They wanted an increase of 1%.)

His assessed value is $422,600, down from $434,000 last year. In order to pay out AltaWest, he needs a mortgage for around 80% of the Loan to Value.

So he has some equity. Also, if you believe him, he was reliably paying the mortgage until it came up for renewal and he balked. He also has some headwinds:
- He is insane.
- He is in foreclosure.
- The condo market in the Lower Mainland is suffering.
- His condo is the type that is the most volatile.
- It is unclear what his source of income is, other than disability.
