My friend, I think you will find that Nicholas Robert Rekieta is... in fact... incredibly lazy, and
exceptionally retarded.
For one thing, consider the fact he let his Rekieta Media LLC out of Texas lapse, despite the fact he still claims it holds ownership of his various social media accounts, and operating a business under an LLC affords certain benefits and protections he is now depriving himself of because of his own laziness and/or stupidity.
I rather think we're well beyond the point where "that's retarded" is a good argument as to why Nick would not do something.
Does it even work like that? He's still personally liable for what he says, the only thing I'd see an LLC doing is shield him from lability over what a guest on his channel might say.
I mean I'm retarded but Nick is also a terrible lawyer so I could see him fucking up what an LLC protects him from.
Can you really form an LLC in n Texas and say "that defamatory statement wasn't what I, retard in Minnesota said, this was what my LLC in Texas said."?
I can not say how sound Nick's legal strategy there was. Generally speaking, I tend to think the correct position to start from is "not very." For reasons which ought be obvious to long-time thread participants. Nick is not as well versed in the law as he wants people to think he is.
However, I can say I looked this up a while back, and corporate entities (which includes LLCs) are, in fact, covered under the Texas Citizen's Participation Act. It confers the same protections to both natural and corporate persons. Moreover, Nick was adamant that he would much rather be sued by the KV defendants in Texas than Minnesota. For the aforementioned reasons.

The Texas LLC was made during Weeb Wars as an artifice to try and goad Jamie Marcie (IIRC it might have been Mars Girl or Monica Rial) into being forced to sue him in Texas and risk a TCPA loss. It was always a big brained bullshit plan that had low chances of working due to a lot of reasons that all boiled down to various instances of Nick not knowing law as good as he thinks he does.
Would it have worked? I dunno, but that was his major justification for incorporating Rekieta Media LLC in Texas, and
not Minnesota.
Also, I just remembered that
I pointed out a while back that the formation of the Rekieta Media LLC came
before his Twitter ban. The Texas LLC was created in September of 2019. He lost his old Nick Rekieta account the following October.
So, while he did certainly leverage the LLC to keep posting on Twitter, it was not the primary reason for its creation.
