1. Legal Costs
The first was a easy question asking the total expenditure incurred by Ofcom to date regarding the lawsuit filed by 4chan and Kiwi Farms in the U.S. District Court for the District of Columbia.
While Ofcom holds this information, it is being withheld under section 43(2) of the FOI Act.
This exemption applies because disclosure would likely prejudice the commercial interests of Ofcom or the legal service providers involved.
Ofcom determined that the public interest in maintaining its bargaining position for future legal services outweighs the interest in disclosing specific fee amounts.

2. Fine Statistics
The person requested a confirmation of the total daily penalties accrued against 4chan following the "Confirmation Decision" issued in October 2025.

• Ofcom imposed a daily penalty of £100 starting from 14 October 2025
• This penalty was capped at 60 calendar days to remain proportionate to the breach.
• Following the completion of these 60 days, a maximum penalty of £6,000 has been imposed.

3. Communication Records​

Here this goes into some loser details like internal briefing notes or summaries for senior management regarding jurisdictional challenges raised by U.S.-based platforms under the Online Safety Act 2023.

• This information is exempt from disclosure under section 42 of the FOI Act
• This section protects information subject to legal professional privilege.
• Disclosure would prejudice Ofcom’s ability to obtain free and frank legal advice for ongoing or contemplated litigation.

4. Service of Process Policy
The final requested part of this FOIA was an, internal guidance regarding the procedure for serving statutory notices to U.S. entities, specifically concerning the U.S.-UK Mutual Legal Assistance Treaty (MLAT).
