Looks like that Waid/Zaid's "truth as defense" case will not work under Texas law with regards to torturous interference.

It's tortious interference, that is, interference that is a tort, not torturous interference, which would be interference by torturing someone. While listening to Mark Waid screeching insanely over a phone might be torture, that's not what he's being sued over.

Something Rekieta didn't mention is that the truth defense could work against the defamation claim, although neither party probably wants to argue much about the truth of the claims themselves, because that means doing it in front of a jury at huge expense to everyone. It's a much better defense to argue that the claims were protected opinions in context of the defamation claim.

That's still an entirely different cause of action.

Waid could prevail on the defamation claim and still lose on the tortious interference claim.

The complaint cites Waid's threats to put Antarctic out of business as what caused them to cave in, as they were already aware of the defamatory claims and unmoved by them. Waid calling them and letting them know he and people acting in concert with him would ruin Antarctic utterly was what caused them to cave in.

Threats like that aren't protected, even if they are truthful. After all, the Godfather really will make sure you sleep with the fishes if you don't take the offer you can't refuse.

I'm reading through the names of the donors and found some real winners in them like Chris Ryall, Tony Isabella, Dan Slott (who chipped in $500!), Jamal Igle among others. It really does feel like they're circling the wagons, doesn't it?

I have to wonder at the shear stupidity of any Comic Pros or industry insiders that would publicly donate in this way. Do none of them realize that doing so builds and reinforces the Pkaintiff’s case? That it puts themselves on the Plaintiffs Discovery list? “We would like to see any direct or group communications with Eric Larson or any Principle Officers of Image Comics as well as Marvel’s Dan Slot.”

I’m not saying that no Conic Pros should donate to a friend in need. But Dear Lord people. Just privately give him a check. These fools make Meyer’s Lawyers job much easier.

Rumor has it that Waid hoped to somehow construe this as a first amendment case so that he could get access to the comic defense fund to pay his way. Seems like he wasn't able to do that. This numale pig needs to have his shit pushed in by the law instead of his female co-workers' bad dragon dildos.

So far as I know, the only major case where the CBLDF stepped in in a private dispute was when Starbucks sued a parodist, and it was pretty clearly a noninfringing parody.

It would be outright fraud for the CBLDF to collect money for First Amendment protection and then spend it in favor of a rich guy who trampled all over someone else's First Amendment rights to try to stamp out an indie comic, for no reason other than that he personally disliked the guy who wrote it.

You are correct. Nowadays they mostly just step into a situation when a schools bans a book or some shit. However, just because something is against the law doesn't mean idiots won't try it. These "progressives" seem to think they live in a world where as long as you do what you perceive to be the right thing, the entire crowd will stop to lift them on their shoulders and have three cheers. Waid simply found out it earned him a lawsuit.

My guess? She was already after attention, being a failed cosplayer, and this gets her asspats. She enjoys the dopamine hit of the outrage brigade that being 'on the right side of history' gives her. She probably genuinely believes that there's outrageous harassment and bigotry coming from ComicsGate, like she would about GamerGate, because that narrative can bend reality for those who want all their enemies to be evil, and while there has undoubtedly been some, blowing it completely out of proportion and claiming disagreement = harassment seems SOP nowadays.

And maybe, just maybe, there's a part of her that saw how profitable it was for people like Zoe Quinn and Brianna Wu to be a prominent female (or 'female') victim of neckbeards and speds and she decided to jump on that gravy train if she could. I think she's cynical. Don't know if she's consciously that cynical, though.

I've thinking lately and wanted to posit this theory as insight into Mark Waid's psyche: is it possible that he was verbally and/or physically abused in his youth? I recall making allusions to a troubled home life when he first saw Superman in 1978. He wrote Impulse #6 that dealt with the parental abuse of one of Bart's friends. The story implied that it that it was the father, but the twist was that it was the mother who did it. It makes me wonder if Waid was writing from experience. He does seem to be incredibly submissive to women, and need I remind you all that the Alter Ego incident happened because his then-spouse/girlfriend wanted the other co-owner out of the picture.

I just bring it up because I get the impression that said abuse can warp minds. A personal lolcow of mine also claimed to have been in an abusive household is also the biggest anti-DCEU sperg I have come across and has an unhealthy attachment to the DC Animated Universe (he never fails to mention how he convinced his parents to name his brother Clark.) The big reason why he hates the upcoming Aquaman film? Jason Mamoa is not a blond. How this relates to Mark Waid is that they have taken the escapism of the medium too far.

In the case of Waid, I think his mind is so twisted that he thinks he is Superman on some deeply visceral level. Not so much that he believes in truth, justice, and the American way, but because he is intoxicated by the idea of absolute power and how it would place him above the law and social conventions. He wants power to strike back at the people who hurt him when he was a helpless child and now wants use the power/influence inside the industry to hurt others as proxies. He used his influence to scuttle Richard Meyer's contract with Antarctic Press solely to soothe his wounded ego, which has festered over the decades. Who knows how many others Waid has hurt with his antics.

Again, this is purely speculation, but I believe worth considering.

The thing is, on Mark Waid's Wikipedia page it makes NO mention of who his parents are (or were). There is no mention of any family at all, in any capacity or anything on his personal life. His parents could have been Democrat Trailer Trash (being he was born in Alabama) or unfathomably wealthy, but it wouldn't surprise me in the least if one or the other or both were abusive in some way. Or it could just be (given Mark is more or less a redhead) a genetic predisposition to a particularly nasty temper.
 
I've always figured that feelings of inferiority to the superheroes you write leading to having a hero complex were an occupational hazard of being a comic book writer. You immerse yourselves daily in the lives of people who are heroic, good-looking, usually famous, are doing meaningful things with their lives, and never grow old. Compare this to being a middle-aged single childless fat balding screaming weirdo working in a dying industry and you can see why Waid might want to pretend to be a hero; especially when you believe in a movement that tells you that most of your audience are Nazi misogynerds, making your life spent creating their entertainment that much more meaningless.
