Any content posted on youtube (or broadcast on twitch) can be rebroadcast with an original commentary, editing, or both, and be considered fair use.

Fair use items can be monetized.

There's certain guidelines that are up for interpretation. To nobody's surprise, Dave has interpreted them in his favor. However, the general consensus is that Dave is incorrect.

Feel free to research fair use and the like. It's a complicated and messy process, and everyone has a different take.

The main problem with VB was dishonesty and sensationalized video titles. It was like posting a video with Dave's face on it, with the title being "DSP eats baby on livestream" and then the video is just old rehashed footage of Dave making dumb jokes for 15 minutes. And there are ads on it.

Not entirely related but there's an interesting situation with popular (and actually good streamer) Asmongold. He's actually entertaining enough that there are absolutely heaps of "highlight channels" based entirely around him. There's one official one but the rest are just people who cap his stream and post MONETIZED highlights, to pretty great success too. He's mentioned a bunch of times that he's been told that he's completely entitled to either DMCA them off the internet or claim the monetization for himself. He doesn't do either because he essentially views it as free promotion for his channel (and I don't think he's hurting for money, I know he got upwards of $10k in one stream last week).

I think if Phil actually had Management and cared enough, he could probably claim VaultBoys stuff. Throwing a few gifs and sound effects in isn't really enough to be transformative. He'd probably struggle to do this as just some random masturbator with a YouTube account though, you typically need an MCN with some sort of clout to do this easily. It's definitely not a good idea to monetize your stuff if you actually want him to fail. If he does fall ass-backwards into another MCN they could potentially claim an awful lot of the detractor videos. Phil already gets way too much money from detractors, he really doesn't need any more.

Its interesting he is down to 6 whales now, swagginz is no longer one he just soapboxes the entire time. I dont think he will tip that much at xmas now, I used to but he not mentioned it for months I honestly think he himself is borderline debt or poor himself. So the whales are; infinite_55, grazydream, creepyspaghetti, jii_el and gc. This is pree bit cap change toowell we saw a bit in late Nov.

His Youtube viewership is down again, he will be near the point he is making 500$ He should realise its done at that point. Kghaleon is the real chsmp here keeping him afloat with gifted subs. Its getting interesting AF

That's right, the first of december of the current year, the year of 2018 in which I got *minisnort* supported by all of you, so my business - it's not a business - uuuhm, so I can still do what I love to do. And this is creating fun and chill khantent for all of you, so we can keep up having a great time together, with lots of transACK-excuse me- interactions during gameplay, you know what I mean? However! As we all know, despite all this pahsitivity there is this big negative influence, these assholes who spread lies and try to bring down my fun streams, just because they are jealous and malicious people. Yes, they really are *snort* and we can't do anything, just let's hope karma will hit them hard. *rockin back and forth* These negative assholes are the whole reason I have to deal with these current problems. As you all know, as my contributing fans during all these years, know I am in a very unique situation right now where uuuuuh *stares at the walls* I can't afford anything. Go on my patreon, be a patron, you won't regret it, you have a lot of power over my streams there, okay? Second! Tip me! This money goes right into my bank account and therefore my credit card. Speak to your friends, tell them DarkSydePhil is here, he is still making content, he never gave up and he creates fun and chill content you can enjoy on a daily basis, you know what I mean? You can bet Swaggins has been saving all his cash for the Christmas event. When most of us buy gifts for our loved ones, he needs to waste it ON someone who doesn't deserve it just because Swaggins has no purpose otherwise. He probably will think that the pisses off detractors with it but all he does is proving us he's quite a sad person.

I'm honestly not convinced he will. He's been ragging on Phil pretty hard and frankly seems pretty tired of Phil shitting all over every single game. In particular, Swagginz has expressed enjoyment of a number of games he's played himself (all in chat) that Phil crapped on because he couldn't be bothered to understand basic mechanics and gameplay.

i still cant get over that, imagine making over 7 grand a month at the minimum and crying woe about how much debt youre in. seriously, you have to have a 2nd grade education and mentally disabled to be in debt with that kind of income. it almost doesnt seem real...

Two KHANDO mortgages will do that. I feel like Phil's known expenses easily top $5k a month, and then you add on his food and debt payments and the taxes he's supposed to be taking out....he ought to be able to live well, but he's done too many dumb things.

Honestly, the h3h3 lawsuit cleared up a big chunk of it. I'm not a lawyer, but the judge appears to rule that you can use portions of someone else's video in your own video as long as you're not 1) just playing the entire video (even if you talk over it) and 2) are using the video for a critique or commentary or whatever. Basically, a TIHYDP video that edits Phil's stuff down and provides criticism would almost certainly be fine. The people who used to (and still do?) simply re-upload Phil's stream and flip it over or voice-change it or whatever are probably actually doing illegal stuff.

It was large cheers. I think Swagginz put up $300, and then Austmink put up like $500 a day or two later. Looking at my stuff, it looks like it was July 3rd for Swagginz and July 5th for austmink.

Not 100% sure of the legality, but the stigma attached to detractors monetizing videos is a carry over from the Sok. They were adamant that no detractor should make money using Phil's content and a lot of people went along with it. Some may still care, but from what I've seen the majority of people don't give a shit.

What are the odds he waddled into some predatory lender’s office and about is to fuck himself over even worse if he succeeds in getting the refinancing he so desires? Could it be that sleazy mortgage arm of Wells Fargo he worked for so many moons ago?

Yeah it being monetized or not was just a question, and I felt it was leaked over from the SoK days. I would lean more towards them if they are monetized just to make Dave even more upset.
My only issue though is what was said earlier. The clickbait ass titles. I really do not like those. The whole Salt documentary memes get really old as well.
