It just dawned on me that Susan's sister in law is a judge dealing with child abuse cases. Anyone have any clue if she would give her free advice??

I doubt she would, the brother seems to keep as far away from the trashfire as possible and if she's a judge she will know how fucked Susie is.

I am very happy to hear this news. I really didn’t think it sounded hopeful, until Sophy admidded on National TV that Susan could kill her son. Then he was under the gun, so to speak and he had to do something.

Like Mirna, I’m impressed that they planned it at a time when Mike couldn’t interfere. He may not have cared enough to take them anyway, but they made sure of it. Now they’ll be appropriately evaluated.

That said, he should go out there, hug the kids, tell them they are in the safest place they can be, to be good, and he loves them. But maybe he’s not allowed.

He doesn’t have to say anything about taking them home, just that he’s still and always will be their father. It possible he gets to talk to them on the phone, if so and that’s all he needed to say.

Now will come the investigation, and Mike should cooperate. Maybe he can cut a deal. They should get child abuse charges, especially if it turns out that Bodhi has a TBI, as I think it will. Still, if the only way they can get Susan is with Mikes cooperation, I’m for that, as long as he never gets these kids again. Would prefer for him to have consequences too though. Nobody gets to go through adulthood saying. She was loud, it was easiest!

The shelter that they are in is like the ones the Turpin kids entered. It’s more a group home than anything else and it’s nicer than anything the kids have experienced previously.

Sadly, unless there is a court case we may not know what the kids eventual diagnoses will be, which kind of leaves us hanging. But ultimately it won’t matter. As long as they don’t end up with their parents again, these kids will be better off and will have a chance to maximize whatever potential is left.

Susan may post again but I think even she, facing a court case, can stay away. We’ll see though.

Sad case from start to end but here’s hoping the kids can have some semblance of a life now.

Psychiatrists are notorious for not realising psychosis can be a direct result of med withdrawal and instead diagnosing it as a "recurrance" of schizophrenic symptoms and using it to justify restarting the meds. Med withdrawals can also go on for many months.
 
I'm just getting great pleasure imagining Susan freaking out, having a melt down. You KNOW she wants to post on FB and try and rile up her troops, so to speak. My guess is Cory is stopping her and probably they have already met with a lawyer who told her to stay off the internet.
 
Really though? What would happen if he didn't send the next check? Would she have to go to court and say he is no longer paying? How exactly would that go over?

If hes being garnished he wont have a choice. But he could choose to stop against court orders and she would have to take him back to court.
Edit to add that yes that would look bad on him if he does have a choice and chooses to stop. He has to follow the current order until replaced

Given that this is high-profile now I'd imagine they aren't throwing bottom-of-the-barrel morons at these kids. And I hope they're titrating down on those meds slowly, especially for Jani who has been on them for a decade now.

They'll let her fully detox so they can get a clean diagnosis.
If Susan is arrested is there a chance she'll be evaluated and if so what do you think she has other than Munchhausen? I can easily see bipolar, borderline, or histrionic personality disorder.
Probably borderline with a generous side of narcissistic.
 
This information comes from my personal experience in dealing with CPS in California and having children taken away (not my children). Since the situation I am familiar with deals with an infant/toddler, this means some situations will change.

With the children being in the shelter, Susan still has the right to be notified of any and all doctor visits. However because Wednesday's emergency hearing has not been held, she will NOT be able to attend. This is the time when CPS gets all their ducks in a row.

CPS is currently contacting any and ALL close family members. This means Susan's mother, brother, and possibly even Cory's daughter will be contacted as potential guardians for the children. Even if there is no way in hell they can help out medically challenged children like Jani and Bodhi, they have to be contacted. CPS wants to keep children with family, yadda yadda yadda so they have to at least go through the motions here. Even if one of the family members did want to be awarded custody until everything was decided, they would have to be approved, have their house inspected, etc., etc.

If no family members want the position, then the default is for the children to be remanded to a foster home/shelter, which they are already at. Like others with more knowledge have said, this is probably where they are best going to be cared for.

On the off chance that family does step up, does get approved, etc., they will NOT be able to allow Susan and Cory around the children. PERIOD. Very bad things will happen if they do so.

At Wednesday's hearing, CPS will say which statutes of the family code have been broken. There will be initial brief testimony as to the evidence that was found. Susan will NOT testify. This is similar to the preliminary hearing in a regular court trial. Because of their financial situation, Susan will most likely be assigned a pro bono attorney specializing in family court matters. Michael will also be assigned his own attorney, but possibly not at this juncture since this case doesn't involve him just yet it seems insofar as the charges of breaking the family code.

The judge will decide if there was enough evidence to justify yanking the kids. There is NO WAY IN HELL he/she will decide otherwise because CPS has been on the case for far too long IMO. Determination as to where the kids will be and the appropriate care for them will be set as well. It is possible that the judge will also set visitation with Susan, but it is also equally possible that this will not happen. Visitation will only be allowed with a CPS worker present the ENTIRE TIME and will most likely only be for a few hours a week. Visitation will take place at a third, neutral location - the purpose is so that Susan will not know the children's location the rest of the time. Visitation may also not start occurring for a week or so. It depends on how backed up things are.

Then starts the real process which will take MONTHS. Susan will need to decide if she pleads guilty to whatever infraction of the family code took place. If she chooses to fight she may be determined to not be available to be reunified with the children at all. In that case, the children would either be placed with Michael or if he is determined to not be a good choice, then they will again go to the relatives first for guardianship, etc., etc.

Because Michael is in the picture and has said that he doesn't want to give up custody, he may be quickly determined to get custody. It all depends on how the charges are placed by CPS. Are they against Susan alone? Or is Michael named as well? And then we run into the question of real charges which would involve actual criminal charges and a trial, etc.

No matter what though, even if the court quickly determines that Michael should have custody, or if eventually they are given back to Susan, it will be MONTHS before something happens. The children will be evaluated, detoxed, and hopefully started on the appropriate therapy to attempt to get them back to some semblance of what they need to be. Susan will have MINIMAL contact with them throughout the process. Michael may be granted more. I do not know how phone calls work with these sorts of situations because when I dealt with things it was with an infant/toddler and they just don't require phone priveledges. Susan and possibly Michael will have to take classes depending on which charges were brought. The classes can be expensive and difficult to get scheduled for. If you don't complete them, your kids will be yanked permanently.

I will say this about the system. It is shitty. In family court you are guilty until you are proven innocent. I do not like that because it goes against everything I have been raised to believe about the court system. But in family court once you are dragged to the dock, be prepared to be in hell for months. You will have delays after delays. Hearings will be scheduled once a month if that. And then rescheduled time and again. Hours of waiting to be admitted to the courtroom. It's awful. But I wish all of that and more on Susan.

Insofar as child support. Michael will have to continue to pay it to Susan. HOWEVER, Susan may be required to pay it to the state in order to help support Jani and Bodhi. I sincerely hope this is ordered. It would be just awesome.

I would bet Susan is on the phone with Mama right now telling her she needs her to pay for a lawyer to get the kids back. Idk what Lorraine will do. She does realize Susan is crazy to some extent, but to what extent Idk.

I think Susan’s brother might tell Lorraine to back off and let the system take its course. But that’s assuming her brother recognizes Susan is the entire problem. I don’t think he likes Susan but he may not realize how dangerous she is to the kids.

Given what you’ve said Susan’s brother and mother have been contacted by DCFS to ask if they would want to petition for custody. Her mom is too old and has a spouse who needs care, so they aren’t suitable even if they had any desire.

Her brother would be perfectly suitable, ideal even, and would easily be approved. He and his wife are attorney/judge, upper middle class professionals that have raised kids. But that also means they have the common sense to refuse to get pulled into this shit show of Susan’s making and try to fix the two kids she destroyed. They would have to totally up end their lives and careers to care for Jani and Bodhi. I doubt they would even consider it, mostly because it would mean Susan’s drama would overtake their lives.

All that said, I do worry the family will still think Susan is better than state care and help her get an attorney to fight the removal.

I have a family member that works in a DCFS run children's shelter, most likely (hopefully) similar to the one Jani and Bodhi are in. In his house the kids are well taken care of, there is staff supervision 24/7 and medical care available on-site. Each child gets an allowance from the state to spend on clothes, school supplies, a treat or two like toys as well.

I'm hopeful the kids are in a similar situation. Definitely better than being with Susan.

Susan is definitely (and dxed) bipolar. I highly, highly doubt borderline. She doesnt and has never self harmed or attempted suicide. She has a very stable identity as a warrior mom, activist, author and up-and-coming media personality. She has no emotional dysregulation - she is constantly manic and never depressed or down. She is not really impulsively aggressive (although she could be towards the kids - however I tend to see acts as hot/cold punishment showers as calculated aggression). She also has very high self-worth and esteem vs the low self-esteem and feelings of worthlessness usually seen in BPD.
I would wager she is a narcissist, histrionic - and probably a sociopath. I'm no psych though.
