This is what would happen:

Toei tells Youtube 'Teamfourstar is stealing our property on these 200 videos'.

Youtube takes those videos down and suspends the channel from strikes.

TFS disputes this with fair use.

Toei denies the dispute immediately (Funimation isn't there to tell them to stop), because Youtube's fair use dispute system is stupid.

TFS loses their youtube channel.

TFS lacks the funds to even try to sue Toei about this, and so they have no recourse but to try to find an alternative platform for their videos, which has never worked out for them so far, and hope Toei doesn't come after them with CND letters there.

It doesn't matter that the law backs TFS up, Youtube won't, and the team doesn't have the funds to make the law do it.

except that would be blatant leak of contract with TFS and while suing Toei would be hard (not that that's how'd that'd even go down, i'll get to it in a minute) they could very easily sue youtube for breach of contract because they suspended their channel for no good reason. why would this apply? fun fact, terms of service are in fact contracts. while many do include a "we can ban you for any reason" clause, it does not cover or let them lie about the reason and that will lead to a very entertaining lawsuit. true, TFS could be soyboys and let it go, but it is their livlihood and baby. I doubt they will. then theres the fact that fanboys will just tweet, mail, and email TFS clips to Toei to piss them the fuck off.

on the other hand, that's not how youtube works. you get a strike, you dispute it, they can reject it, then you can say "if you think i'm wrong about fair use, then sue me", and then Toei either has to or admit its wrong. so far? not a single japanese company has been bold enough to even think about firing that gun. further, nowadays all strikes from a single company count as one strike until fully resolved. only when 3 are resolved and found simple, then yeah.

This isn't considering the fact that technically, they could just decide to nuke the vids, being simply posting vids directing people to their site, then putting other, non-DBZ content just to tell Toei to suck a bag of dicks.

This would be terrible. We'd go back to the dark ages of anime not bothering to get releases here, bad dubs, and a ton of innocent VAs - Vic included - being out of a job. At most Funimation is going down, I'd think. Maybe Crunchyroll too. However, I anticipate Funimation will settle.

Incidentally, Funimation settling is the ideal for TFS. It won't drag them down, it will open opportunities for them where other VAs will be vacating spots, and it will make things overall a less hostile working environment dealing with Funi.

not really. with the internet and subbing culture, getting subs would be so easy for studios, it's honestly probably better they do this anyway. if what some people say about the US's share of profits is true, probably would make them more money to cut the dub weebs off the fat.

Goblin Slayer was attacked by Cordyceps brain stemmed-SJWs because of the fact that the source material has to deal with Dark High Fantasy with a setting that has people come to understand why monsters such as the lowly goblins of typical jRPG/wRPG setting are actually despicable filth that breed by raping, impregnating and killing human women while massacring humans in general for domination and pleasure, and why a hero adventurer simply referred to as the titular "Goblin Slayer" would commit himself to a career of hunting and slaying only goblins.


They didn't read the source material (in which you could read the thought bubbles of the titular creatures) and attacked for being sexist and misogynistic because of the brutal and graphic depictions of said content (which on the aired anime is NOTHING compared to that actual LN content), because of the stylistic choice of showing and not telling the setting during EP1.


People getting sick of this shit simply defaulted to anyone complaining about this "edginess" correctly having not researched the source material, and this carried over to Tate No Yuusha no Nariagari (The Rising of the Shield Hero) -- except that it didn't work then either, because the LN author Aneko Yusagi is female and wrote the story exactly for the themes of exploring how a hero in a Isekai story would deal with being made into a martyr and punching bag due to false allegations.

You're trying to compare an apple (Ecchi Comedy Isekai Anime) to a durian (Dark High Fantasy Isekai Anime), there is no real comparisons to be made between the two, except to the immature, uninitiated and uninformed masses who don't look past the MAL entry descriptions and the screaming heads of Cuck-Soylent-FunkoPop anime bloggers.

They actually attack all of these anime equally, because they fucking hate all of the following:

  2. Ass
  3. Fun
  4. Non SJW-compliant talking points any episode could be mined for OOC
  5. Fun
  6. Interesting Topics/Subjects/Ideas that r/woosh over an SJW's sensibilities.

He made so much "fuck you" money off that show and it's subsequent syndication deal, that he was able to reject every offer made to him after MITM (which basically had him playing variations of his dad character from that show) until he was offered the lead in Breaking Bad, which he took.

Because of this, Cranston is part of a large circle of actors who basically have enough money that they can take a "holier than thou" attitude on their earlier, starving actor work. Which is also ironic, as Cranston fancied himself a would-be "serious actor" prior to landing his role on MITM and opted to live off his residuals than continue to do comedy, until he got his dream gig on Breaking Bad, to let him finally be a "dramatic actor" and not the latest incarnation of the cliched "dumb submissive husband who's wife runs the family with an iron fist".

Toei would need to sue in the US because youtube (google) is a US company and it's servers are primarily located in the US. Thus the action occurring is in the US by US citizens. And as our Dear Feeder so elequently stated, the US doesn't give a fuck about some other shithole country's laws.
For an entity that was purely based in and operating in the US, that would be correct, but Google is a multinational corporation with a presence in Japan. If a Japanese court wanted to assert jurisdiction on Google, it could, and then it could enforce its judgement against Google's assets there.

I'm somewhat interestedly watching the Meghan Murphy lawsuit against Twitter, which basically covers exactly what you're talking about: selective and discriminatory enforcement of its TOS. That lawsuit, if successful, would completely change the landscape. I'll be honest, though... it looks weak, and the chance of a favorable decision is slim. Plus, if it looked in any way like she might win, Twitter would probably settle outside of court so as to avoid having legal precedent set.

except the difference is that the TOS lets them selectively enforce it. however, because its a contract with no "I can lie" clause, they can't make lies when they ban you. it makes them legally liable. true, its shaky legal theory, but its there and when there's legal grey area silicon valley gets scared. enough to maybe capitulate. why do you think the adpocalypse happened no once, not twice, but three goddamn times? because they're cowards and rather just sweep something under the rug than risk anything.

I read 40+ pages of this thread, saw numerous screenshots of REEEEEENfamous screeching, and fun factoids about law and anime to state that: Laura Bailey and Troy Baker most likely stopped doing minimum wage anime roles for big budget video games because they became new parents over the past few months/years. (Not together though Laura with her husband Troy with his wife etc)

Isn't it amazing how they all claim there are "Dozens of Accusers" but nobody can actually name or describe the dozens of accusations. None of them are first hand or even second hand. Nobody seems to directly know any of these dozens of victims. They are all seemingly urban legends. And what makes this real apparent is you can dig back through the social media on their own gathering places, and watch the evolution of what "everybody knows" about Vic morph from "He's a Christian!" to "He's a Christian Homophobe!" to "He's a Creepy Christian Homophobe!" to "He's a Creeper" to PEDOPHILE. All without seeming claim.

If I'm not mistaken, their TOS says that they can ban you for any reason they want or even for no reason at all. That undermines the "they lied when they said why they banned me" argument - they didn't have to give a reason at all. So your complaint is that they lied? Okay, but how did the lie harm you? You wouldn't be able to say it harmed you because of the ban, because you've already tried to claim that the lie wasn't the real reason for the ban that they gave you.

The only potential avenue that you'd have to sue would be if they banned you because you were a member of a protected class. You could try to sue them for unlawful discrimination, but you'd have to prove that, and it definitely wouldn't be easy to prove. There just isn't enough information given in the ban message for you to really prove that their reason for banning you was illegal.

Now, you could maybe try to argue that they defamed you by sending the "we reviewed this and found that it violated our rules against: Hateful Conduct" message to the person who reported you, but I think that would be a pretty hard sell. I don't think many people would want to go up against Twitter's lawyers on that claim, especially not on their own nickel.
