I don't think anybody really thinks double jeopardy applies in any way.
I would hope not. It would mean posters here are just as retarded, or maybe more-so, than Chris.

http://en.wikipedia.org/wiki/Double_Jeopardy_Clause

Basicly if your aquited you can not be recharged with the same offense or on which has all the same elements of the offense

1) He hasn't been acquited.
2) This hypothetical mace-based gas attack is a different incident on a different day against a different place of business.

If anything, they'd throw the book at him harder for not getting the hint the first time.

Anyhow. I wonder if it went down like this:
He walks into Mal-Wart that he ISN'T banned from (maybe to buy a new canister of pepper spray....or axe....whatever. Doesn't matter for this scenario.)
Someone who works at that Mal-Wart recognized him as the crazy bag lady on the TV News who sprayed fumes on Mr. Yellow Shirt at the Gamestop.
Dreading a repeat performance, tried to shoo OPL (acting as if Bann had Already Happened.)
Chris Chimps Out and threatens to spray canned liquid death on every moving object within range!

How badly he chimps out is what we haven't figured out yet, or if this entire incident isn't (imaginary|real but blown way out of proportion|completely accurate and Chris is in the Pokey as we speak).

EDIT: just checked Vine. His status is still "Out of Custody"
Which means he's either fine.....or he is On the Run and is halfway to Illinois by now.

Okay, no.
You cannot be recharged and retried for the same OFFENSE. Offense in this case might be better said as incident. If a guy named Bob was murdered and they arrested me and tried me for it, but declared me not guilty, I can walk out of that court and tell the press exactly how I killed him and why I ate some of his body parts and they can't do anything to me in CRIMINAL court. If I leave that press junket and kill a guy named Steve, I'm going to be arrested and put on trial for Steve's murder and it's not double jeopardy even though it's the same crime.
They could try you for perjury though which is another thing I worry about in his court proceedings. The evidence might disagree with Mr. Chandler's "true and honest" account of the incident.

You know, if this forum hadn't shown him all that disrespect by renaming itself from after his honor to after some stupid Australian animal, this would never have happened I bet.

Oh, who am I kidding, he'd have done it anyway because he's on a permanent vacation from responsibility and acting civilized. If this incident is confirmed, he's going to spend a year in prison if he's well behaved in there, so, he'll be spending more than a year in prison.

well i just got off the phone with a corporal at the albemarle regional jail chris is not there. so i dont know if he could be anywhere else but i know he is not in the jail which held him for the gamestop incident. though pm me with some more leads and ill try to run them down.

It would be my bet that he just got into some minor shit at Wal-Mart and he got the banhammer again.

Wal-Mart is pretty used to dealing with folks like Chrissy and I highly doubt the Jerkops were involved.

Still....it be nice to get an up-date. I've learned that you can't really predict what Chrissy is going to do so it is possible he 'tarded out and maced more people.

Well I Just Called Central Virgina Jail And He Is Not There As Well. The Only Other Two He'd Be In Would Be Middle River Regional Or Rockingham but those seem two far away.

You should call the Wal-Mart stores around Ruckersville, VA and ask if there's been any recent problems with ugly transvestites waving around pepper spray and complaining about Sonic's arms. You could say you're with the county's DSS or something.

well its a bit late now and besides if it were note worthy he'd be in jail.

Chris gets kicked out of Wal-Mart all the time. He's probably not in jail. The fact that we've so far heard nothing probably means that Chris got ejected without further incident and went home.

When Chris goes to jail he will spend his time writing letters in pencil to Sega demanding that they fix Sega's arms.

Ok maybe I was unclear I thought that what I said. Similarly, you could no be charged with Manslaughter for kill Bob

Before anyone says it and starts speculating. If Chris indeed is using pepperspray again, or in any way breaks a law, his bail/bond is over. He does not Pass Go, he does not collect $200.

You're both probably right and almost certainly wrong. There have been a number of people that have commented regarding Chris's bail status. Most of them are incorrect. I want to clear things up.

When someone gets arrested and/or charged with a crime, they are presumed to be innocent. Ideally, they would go to trial immediately in order to either clear their name or be remanded for punishment. Unfortunately, the process of justice takes a long, long time. There is a balance that the judicial system must weigh. If a person is innocent, then they must go free; if they are guilty, then they should go to jail. When the doubt is unknown, then a financial amount is put in place that, when provided, will allow the suspect to remain free until their trial. The bail amount will be returned if and when the case goes to trial.

Consider bail to be an insurance policy that balances public safety with the presumption of innocence. Bail is not intended to be punitive.

Let's go ahead and assume that Chris flipped his shit at Mal*Wart earlier this evening and that he got arrested. His bail money would not be forfeited since the purpose of bail is to ensure that he shows up for his original trial. If he is in police custody for an unrelated offense and remains in jail through his original court date, then he WILL be there for that trial. The cops have him; he isn't going anywhere. His freedom of movement may continue to be restrained and he may remain in custody, and in that sense his bail has been revoked. This does not affect that cash that his mom/uncle fred/bail bondsmen eddy/whoever put up; they'll get it back unless Chris pulls a prison break or does not show up on his court date. Getting arrested for an additional crime does not affect return of bail money

That said, if Chris was arrested again, then a judge will undoubtedly announce an additional bail amount above and beyond what was initially paid. His original $$$ bail will not be forfeited, but more money would have to be put in place before he was released. Again, bail is an insurance policy. If someone allegedly committed an additional offense, the the price of that bail (the insurance policy) would rise.

Hopefully that makes sense.

Depending on any conditions that may have been in violation, in paticlaur if he was order not to have weapons

Chris at this point reminds me of my cousin at age 9... He used to punch holes in walls and break shit so that he presumably felt like he had some sort of power to control things when in point of fact, he had no power to control anything at all.

The difference is, my cousin grew out of it, and is a pretty cool guy now. Chris, of course, will never grow out of it.

32 years old, people. Let's not lose sight of that fact.

Ah, but they aren't "innocent"; To OPL, Dey are all Da Twolls.....you can mace a twoll. Y'see, They don't have feelings or souls or nervous systems. Not like real people.
But the funny thing with Chris, is that he doesn't view anyone as people. They all have specific categories in Chris' worldview, but there isn't a consistent "person" class that everyone belongs to. And that's both sad and the source of Chris' danger to his community.

stuff and stuff.
I was never confused and I don't disagree; I'm well aware that bond/bail is just an amount of money that lets you out of jail until your trial. I wasn't saying that he loses the money, I was saying that he loses the right to be out of jail until his trial. I literally just worked a case where a lady was on bail for an alleged crime, went out, did more crimes, and got caught. The judge said fuck it and didn't offer her bail again. These weren't super violent crimes either. Chris is straight up assaulting people. He will be viewed as dangerous to the public the second time around. While a judge might say "fine, but now it's a shit ton higher", it's very likely the judge will just say "fuck it, stay here until your trial".

18 pages strong based on an unconfirmed report of Chris being Chris that may or may not have happened. And back in the day we bitched about threads about hot wings being too long, now we're packing it in based on a speculation.

......annnd because I said that, it'll be confirmed within the hour.

Anyway, if it does become fact, I hope the jail he gets to sit in until his hearing allows limited internet access. I don't want the last thing we hear from Chris be about Charlie's Horse. Talk about an anticlimactic way to go out.
