Without that, he has to show the alleged infringement caused him financial damages, either through direct damage or loss of profit.

Even sites with fake porn of celebs don't get sued. If they can't get sued, some dumb faggot isn't going to be able to do it.

What he's doing is basically taking money from his wallet and burning it. Suing for copyright over your own or other personal likenesses is INCREDIBLY HARD. Lets just go the steps he'd have to go through JUST to get to the infringement case.

1) Kiwifarms is a platform, not a publisher. Therefore it is not legally responsible for whatever its users post. Null, simply as owner, bears 0 responsibility. If he sues, it would get thrown out under 203. So the first basic lawsuit is a non-starter.

2) Next, he would have to sue Null to get them removed. If Null tells him to get fucked (obviously), he'd have to sue. And that's only to get them off. If Null doesn't profit from them and isn't getting any profit from the user, that's not infringement. So basically, he would have to first burn money to get them taken down. Which if you've seen cases like this before, is just burning money.

3) He'd have to sue the individual user/users using the photos. This would require cooperation from Null. Which Null would, again, tell him to go fuck himself. This means another separate lawsuit where he has to sue Null for user information. And only for that.

4) If he gets the IP addresses from Null, this is where the fun starts. They're still all John/Jane Does. And probably from multiple states and even internationally, with different ISPs. He'd have to subpoena every ISP he'd want to sue. Typically most IPs roll over, but some wouldn't for something like this. So he might have to end up SUING AN ISP.

5) Finally, he gets to you. He sues the user, if he ever gets the information. You file a motion to dismiss. The judge asks how was this faggot financially damaged. He can't prove he was. Case dismissed.

So. He's not going to be doing anything. He's dumb as dogshit. Another incompetent faggot. Shocking, that their side has so many cucks, losers and absolute dumbfucks who think they're special.

Or maybe he just makes shit up when threatening nonlawyers with dumb legal actions. It's also pretty unlikely statutory damages are available against anyone but an actual direct infringer.

Anyway what's important is the effective date of registration.

"The effective date of a copyright registration is the day on which an application, deposit, and fee, which are later determined by the Register of Copyrights or by a court of competent jurisdiction to be acceptable for registration, have all been received in the Copyright Office." 17 U.S.C. § 410(d).

It may or may not count as registered. It isn't in the copyright database yet, though.

Its more likely he knows how the law works and is assuming nobody else does. It's a common misapprehension among intellectual elitists. They got a fancy degree in something therefore nobody else could possibly know anything about the subject. He has probably bullied countless people with threats of lawsuits and gotten his way because nobody had called him on his bullshit.
 
IDK why he'd even try to get copyright protection for his photos, especially the older ones. Fair use aside (which is pretty clear cut), since he's copyrighting photos more than three months since they were created, the only damages he'd receive would be either actual damages, for which he'd need to prove how other people using his photos harmed him monetarily, or an injunction, which is still a pain in the ass to get. Moreover, for anything that he registers that's more than two years old, he'd need to affirmatively prove that he has a copyright to it.
