I'm trying to understand what's happened here and what to expect. If I understand the
BC Court system website:
1. A warrant was issued for his arrest OR it was assumed he was about to commit a crime and the RCMP acted accordingly, which might explain how they showed up so quickly.
2. He could be held for 24 hours but then would have to go to a bail hearing, which didn't seem to happen OR the police can release you on a promise to appear, which seems most likely.
3. At some point, he will appear on a court list on
here. The only problem is that I don't know which court will see him. So I did a search on civil courts assuming BCRT isn't his first time in court. Sure enough, he shows up on the
civil court list a few times. I see a few courts where he (and his family?) go. There isn't a consistent one, like a "Langley Provincial Court" that can be referenced neatly.
I'm not sure that I am closer to understanding where we will see JY appear next, but if I understand the basics, the police didn't need a warrant to arrest him.
BUT WAIT. There's MORE.
According to the
Charter of Rights and Freedoms, S. 8, it's possible the RCMP didn't need a search warrant for his computer to go looking for CP because the evidence of him aiming a taser was on the computer. As in, he made his computer part of the taser evidence by broadcasting from it.
Meaning: if the police wanted to make sure they had arrested the right man, they could simply log into his computer to go see if he was actually on YouTube at the time of the taser incident - and while they were poking around trying to find whatever logs would confirm this, HOLY SMOKES, they found CP.
I'm not a lawyer and I don't even play one on TV, so maybe I'm wrong on everything. But as best as I can interpret the law, the arrest was the start of this, not the end and not a one-time event. Stay tuned on the Provincial Court lists because he's going to have to appear to talk about his arsenal and anything else the RCMP found.
And whoever said that JY is lying about the self-admission of CP is probably correct. My money says the police found it when they were poking through his computer and JY is trying to get ahead of the curve.
