Yeah, sure, but Ty was railroaded and didn't get to say that. "How do you get affidavits" is a confusing question to be asked out of the blue.
 
I'm no big city lawyer, but that seems like a massive mistake on Beard's part. Surely if your goal is to show an interference in a contract, your first port of call should be to submit into evidence a copy of the contract that you are allegeding is being inteferrred with.
I don't think we're dealing with a written contract however. My understanding is that these were verbal contracts and Ty would thus need sworn affidavits (or some other documentation which he would otherwise have had to compel) in order to satisfy Chuppy boy's query.

Talk is chupp wanted specific amounts proven with written contracts from the alleged cons that cancelled.

Ty could have subpoenaed the con owners but didn't because he had a discovery stay.
i don't know if chupp is saying ty could've done it before the stay or during the stay because it was related to the TCPA.

Oh look at that it's exactly as I expected, Chupp's a prick and this is clearly going to get appealed successfully. Frankly pulling a stunt like that when you're a judge should be more punishable than it is. Nobody else on Earth gets to make a pouty face and tell everyone to fuck off instead of doing their job without some kind of consequences, but apparently judges can.

Even if he had come in with the affidavits about contracts that were interfered with and weren't in writing, the defense would have argued that no written contract means no way to prove TI. They'd have a valid point, too. I think Chupp would have agreed, given his entire line of thinking today.

This was, in essence, a Catch 22 scenario: Ty came in thinking (correctly) that he'd have to establish a prima facie case for each charge on each defendant. Judge Chupp decided that it would have a higher standard required to pass it, and the only way to pass it would have been to have discovery happen; however, discovery is stayed during TCPA. Even if he'd moved to subpoena such information, the defense would have filed motions to quash as it would be "outside" the TCPA's limits, much like how they were going to subpoena Nick and Ty said TCPA prevented it. There was no way for Ty to come in because he was blindsided, something even many KV'ers I've talked to agree seems to be the case.

Ty's biggest problem is that the 2nd amended petition should have been submited as the 1st amended petition (which itself should have been submitted on time, the technical problems thing was always bullcrap imo, if filing systems eat filings then those filing systems would have been out already, just think of the hige flow of documents getting uploaded into the TX legal system everyday and you're gonna see why this excuse was so retarded).

That 1st filing was a complete disaster, everything in it was super unclear and there was no real narrative to guide a judge/clerk's hand through the whole thing. The references are a complete mess, and I still have zero idea what the Sabat stuff is doing there, regardless of whether it is true or not.

The weirdest part is when I pointed it out and said that it alone could lose Vic the case people chimped out at me and started defending this LOLyer they never met.

Overall, we're still waiting for transcripts, but I think the hearing went really awful for Vic, I think Chupp will definitely strike out some more claims, if not all of them, but let's see what happens.

People are far better advised to stay pessimistic until things properly shake out.

Nick has consistently been the Zaid of this case, full of false bluster and just keeping a circlejerk going.

He literally said that all Vic had to do was deny everything and he wins on defamation, if he didn't make it look like such a sure thing, then no one would have donated to the GFM (at least not as much as it has). The fact that he defended that shitty (and late) filing is alone enough to convince people (Seriously, go read it already, it's pure LanDUI).

For me, Nick and Ty are an inseparable pair when it comes to criticism (and comedy!). Like Laurel and Hardy.

I spoke with a paralegal who is KickVic who was at the hearing, and even she said she couldn't understand Chupp's reasoning for tossing TI when it comes to MoRon, because, and I quote, 'There's no way that anyone can deny those were intended to frighten Chris into doing what they wanted."

Judge Chupp was "compromised" quite awhile ago. He was openly hostile to Ty during the last hearing as well. Its a shame we cannot somehow get his communications such as emails and phone records. I would like to see what was going on behind the scenes. I think he is a corrupt judge.

We need Ron Toye's emails/phone records as well. Funny how a "judge" can rule on evidence when discovery was obstructed and stayed.

The airport badges have built in RFID chips. The elevators wont operate to restricted levels unless special personel enable the access. There are "aliens" at this base but to be honest I think they are actually DEMONS or other interdementionals inhabiting genetically engineered bodies. There is nothing good about these entities and they do not have any well intentions for humanity. There are train stations on the upper levels that can take people (mag lev high speed) to Dulce, cheyenne mountain, area 51, area 52, and most other strategic locations in North America. Dulce is a circle of Hell its where they do human experimentations on the border of Colorado and New Mexico. They also take a lot of people and children they kidnap crossing the border and traffic them. They also kidnap people in general for trafficking purposes.
