Maybe. But if they blatantly do that in front of Chupp, well, they're stupid. Even if he can't officially consider it, he's going to watch to see who actually does what he says and who just blows it off. Both sides would be wise to at least pretend to go into the mediation with good faith.

The email and the tweets - which I have it downloaded - are very disturbing to look at. Is it possible that reaVer is either neutral or KickVic since he's not ISWV/Vic-Stander?

Having dealt with several suits like this - Kimberlin and Schmalfeldt related - Justice is always very hard to come by. We had a saying of "but Maryland" because every time the evidence was slam dunk for X the judge ruled Y and somebody got away with something - up to and including refusing to come to court for a judge ordered bitch out session and nothing happened to the person. It made me jaded about the legal system as a whole. I had thought that Texas would be different. It's not. The same sorts of things happen. I just hope this time it can turn around to what the evidence shows.

Very good point, we do not have a clear picture, and it may be a move for the judge who may have dismissal of defamation in his mind and saying "Try to work this out" But the defendants Toye and Rial have already put in their pleadings that they have NO intention of any mediation. I do know this guy (Chupp) was in no mood that day, when he walked in the court and we "all rose" he just sat and got right into it, we were all still standing. The guy was really salty.

As I understand it the claims on Marchi are dismissed, but, the defamation on toye/ rial and Funi are still up. but I also understand the judge can reverse his decision within a small time period, could that be this case, I don't know it can go two ways as I see it. 1. all claims are now turned to see trial, or. 2 could this mean the judge is ready to dismiss defamation and is asking for a last try at mediation.

Probably worth taking a deeper dive into their nutty world to see where it leads up, could be someone from either side pretending to be a neutral party on a gay op.

So Chupp is melting down over a single sperg on twitter? Call the FBI and let them talk to the 12 year olds mother. Besides which a reasonable case could be made that he is simply a disgruntled citizen exercising his 1st amendment rights to petition a branch of government. I don't see any direct threats here. At least nothing much outside of what most of our founding fathers published. Remember Jefferson's "The Tree of Liberty must be watered with the blood of patriots" bit? Serriously if Chupp is freaking out over one loser on the internet throwing twitter rocks at him, he chose the wrong profession and should best return to his monastery.
