I'm throwing up the @AnOminous signal because I'm itching to read him blow John's stupid ass out of the water over his smug definition of "discovery" vis a vis NYC's insane new "premises access" hearings, but in the meantime I'd just like to point out that one of the biggest issues with it is that it'll allow domestic violent defendants to return to their homes despite there being orders of protection generally in place to prevent it. Granted, they already are permitted a visit under police supervision to retrieve belongings, but if you think these crime scene inspections won't be used to intimidate witnesses, you're nuts.

Of course, being married to a domestic abuser, John is probably okay with that.

I haven't seen the new law and am not finding any particularly good stories about it. Charlie Kirk is a moron, though. The right to know and confront your accusers is fundamental and basic. You obviously get a list of them. This isn't some newfangled Deeeeeemonrat idea. It was literally a core, fundamental concept the Framers baked into the Constitution because of the abuse of hearsay testimony in England. Most fresh in their memory was the trial of Sir Walter Raleigh for treason, in which he was not permitted to confront his accusers.

You're also allowed to see the evidence against you before you go to trial. Another fundamental right Kirk doesn't understand.

NY is notorious for shoddy discovery procedure and I would assume they are referencing this which appears to be a step in the right direction.
Effective January 1, 2020, New York State is replacing its discovery law, dubbed the “blindfold” law, with a new statute requiring the sharing of evidence by default between the prosecution and defense on an accelerated timeline. The reform may shrink case processing times, resulting in shorter jail stays for defendants held in pretrial detention.
