Volney's got to take the chance if he can. I think his argument is going to be that Funimation's tweets are being taken out of context and that they can't be liable for others misinterpreting their meaning. Granted, they never once over the course of the year attempted to clarify their statements but it's something to work with.
I feel like if Funimation had actually done an investigation, even a crooked one, they'd have produced something from it by now. They keep talking about one but never actually produce anything from it. That's going to be a tricky thing for Volney, especially since Ron, Monica, and all their idiot pals keep citing it.
Volney's other big problem is trying to distance themselves from Ron, Monica, and Jamie. The brief did a good job at making the case for at least Monica and Jamie acting as agents using Monica's testimony (lol good job there). Monica's communications with Funi HR requesting advice on what to say and then later requesting a statement from them are pretty damning. I suppose he could argue that Monica doesn't understand the nature of her work relationship with Funimation but nobody bothered to correct her.
In short, from a legal neophyte, Funimation has a couple of plays but Martinez/Hsu really made this tough for them. Best option, as always, is to completely separate from Monica and Jamie but I think they made a fair case for the nature of Funimation's relationships with the other defendants to be examined more closely. The only person who I feel is absolutely fucked is Ron (and likely Monica via association). Just some bored ramblings/observations while waiting for a meeting.

With all the information involved, I'd agree that Ron is in the worst position, but reading the latest filing I felt there was a big focus on Monica. She was used as the lynch pin for the civil conspiracy. Her name was all over that filing. My favorite part was the section where they were laying out how Monica and Jamie were acting either as employees or agents of Funimation. They laid out how Monica's communications with the people at Funi showed how they had control over her public statements on the case - and then concluded that because Monica and Jamie have very similar jobs, if Monica is an agent/employee, then so is Jamie. So if Jamie ends up still on the hook for civil conspiracy, it's going to be squarely on Monica. Wonder how Ms. Ride-or-Die is going to feel about her friend after that?

Well, Jamie might settle but she's the only one who is able to leave this lawsuit with little damage, but if she's hooked on conspiracy then yeah she's either going to settle and will probably sell out some info

Jamie is arguably more of an employee than Monica is. Monica has done scripts for about a half dozen shows, and was director for about that number.
Jamie has lots of script writing, and has a few more director roles than Monica.
Vic described the directing of Zodiac War as being different from his normal voice roles.

I was shocked when Chupp threw out all causes of action, especially against MoRonica and especially especially against Ron; however, I suspect, given what we've seen in transcripts, that Chupp realized he fucked up. Whatever was going on that day, he took his bad mood into the court room, he even implied when ordering mediation that Jamie could be brought back on appeal.
Him tossing out the entire case ... while extremely shitty, and as long as the appeals are somewhat if not entirely successful, was perhaps a helpful measure to bring everything back ...
While I'm being cautiously optimistic about appeals, it would be some insane miscarriage of justice to let Ron off the hook. My guarantee, if nothing else comes back, that dude is ... and he'd better lube up.
