Not as many people as some folks had originally hoped. There's a lot of pervy-stuff associated with sequential art...and I've got three long boxes of 'research material' I've collected over the years that pretty much proves it.

The first one is NJSA 2C14-9. Invasion of Privacy.

It's inapplicable. He consensually filmed porn for (I presume) commercial distribution. He regrets it's now. That's too bad. It's not like EvS snuck a camera into Hulk Hogan's bedroom and serendipitously recorded him getting his pole waxed. The Gawker case is an example of a legit IoP situation.

As I posted before, this is all a very complicated issue based on some very losely worded law, especially clause (c). I don't know if this law is applicable, but I also don't know that it isn't. It is quite possible that the TOS for the sites where the videos were originally distributed forbade distribution beyond that 'walled garden.' Does posting the content to wider internet count as a violation of consent? Fuck knows, but it will be interesing to see.

No I didn't hold up his tweet as a lawyers opinion. That wasn't my intent. Preston talks about litigation constantly, he has money and he said he'd consulted a lawyer so I took him at his word.

Do you think he didn't consult a lawyer. Why wouldn't he?

I said it's unlikely that he has a criminal case and that it's likely he's pushing for an investigation so he can use what comes up in an attempt at a civil case.

My guess is Preston wants to make it to discovery more than anything.

So far it seems to be working for him. We'll see how it turns out.

Nick just said the same thing in his Discord. The statute was updated in 2016.

There is no fucking way he got this from an attorney. An attorney would have confirmed the law is current first. Even I pulled the 2013 revision earlier.

If you read the current law it's even more clear that EvS isn't going to be charged with anything. Section C requires all the elements of section B to be satisfied. Section B makes clear the law concerns serendipitous recordings. Not involving yourself in an actual porn production.

So there's your legal opinion from an actual lawyer.
