I was pretty disappointed with that document. It's not like the date the appeals were going to be heard on was sprung out at the last minute. Whether or not there's a deadline is pretty irrelevant if the court was going to consider the case on the 22nd and then spend three months writing their opinion who cares what is filed on the 23rd.

I'm convinced that he timed this for the 22nd because he knew people would want something on the 22nd related to the appeals no matter how many times he told them not to. He wanted it to be finished on the 22nd, even though it didn't need to be, but got busy with things. Given that he tried to pull an all-nighter for something with no deadline, it only makes sense the deadline was for his show.

I really don't want to go to Texas. I hang out in a virtual space that has enough cows as it is. That's too much hamburger for me.
 
Not true. He could sue him in Texas and claim Texas's long-arm statute covers Nick's behavior and therefore, there is jurisdiction in Texas and Nick has violated his rights under Texas statutes.

Not even that. In Nick's amicus brief he mentions that Rekieta Media, LLC is an LLC incorporated in Texas. For the purposes of jurisdiction that would cover it.

That might actually be legit. I once saw a former AAG, who was working in an administrative capacity at a government agency, write a brief that he had a current AAG paste over his signature and submit to the court.

If it's not legit, those guys fucked up.

Nick needs to pump the brakes on fucking with Ron. I know he thinks it's helping his show, but Ron is a crazy retard with some amount of money. Ron will do something retarded like file a frivelious lawsuit against Nick, and it won't be as fun/funny as Nick thinks it will be.

Ron sucks, and he likely isn't going to do shit.

I think the bigger issue here is one of Proverbs 16:18 ("Pride goes before destruction, a haughty spirit before a fall."). The thing with Nick is he's amped this up so much that he's going to have to eat an enormous amount of shit if the decision is affirmed. I don't know if he doesn't care, or he never considered the possibility. I have never seen any lawyer act quite as bombastic as Nick. It's funny to a point, but I don't know if it's always a good idea. His Twitter chimpouts get old after a while.

My point is, it'll be a ding to his social credit, and the financial hit will not come from a lawsuit, but possibly less superberries. Anybody who thinks a loss for Vic isn't going to affect Nick at all is foolish.

However much money Ron thinks he has, it's not enough for a lawsuit against someone who can represent himself for free.

Lawyers do not do that. Unless they're stupid. The ABA and other professional organizations have said that the "fool for a client" maxim is universal and applies to active lawyers.

Calling my shot now. Everything comes back because Chupp bungled the TCPA procedure. Ok OK. I 'd say Marchi gets out, but discovery should be allowed to rope her fat ass in for Civil Conspiracy.

I hope that they'll toss back the TI shit. I've always felt that was the strongest argument.

I am psychologically prepared for the possibility that it'll be devistating for Vic.

I think it is EXTREMELY unlikely they'll reverse everything. The Marchi shit was always pretty weak.

I also think the Texas Supreme Court would deny cert. There's really no novel legal issue in this case.

I would guess Ron brings in around $80k annually. Monica is a non union VA in a Right to Work state. She gets bottom end flat fees for VA work. She's not pulling any residuals etc. The bulk of her earnings almost certainly comes from Cons. Of which there haven't been any since March. Bummer!

Nick has been quite upfront that he thinks the appeals won’t go through, because most appeals won’t. He was also upfront from the start that he thinks it should go through, but at the end of the day, it comes down to the judge. There wasn’t any exceptional lawyering going on from either side, but rather one guy who just didn’t seem to know what he was doing. Evidenced by his own answers to a question of why he should be an appeals court judge.

Nick took the hit back when the case was dismissed last year, and seems to be fine with it.

Honestly, the only hit would be to BHBH, as they won’t get much defamation work, but I don’t think that is a concern.

No. Nick took a hit where a trial court decision didn't meet his high expectations (that a lot of other people adopted in deference to his status as a lawyer), and where he said that now is the time to reorganize and appeal.

This potentially won't be the same hit. He can't have the same reaction.

Well... I suppose he technically can... but let me just say that if anybody donates money to the GFM, with the expectation it'll be heard by the Texas Supreme Court, they're an idiot and wasting their money. At least fucking wait to see if they grant the writ.

Otherwise, you are just padding the pockets of Ty, and he really doesn't deserve it.

I have always believed people can do what they want with their money, but I warn people when I think it might be better spent elsewhere. If they ignore such advice, that's on them.

Right or wrong, it'll be educational, at least.

If the panel agrees with the gist of what Nick's been spinning, great, I can count Nick as a mostly reliable source.

If they don't agree, well, Sudderth apparently is thorough and takes pride in her work. She'll write a good opinion of why Vic (and to a certain extent Nick) had no case, and I can evaluate Nick's other opinions in light of that.

I really hope Vic gets some justice, though. Everything points to him being a genuinely good, if not perfect, man, who got done dirty by a bunch of jealous harpies.

Jealous harpies, and Ron, an absolute lunatic that can't measure up to someone like Vic so he decided to tear him down. For whatever reason (probably Vic fucked monica).
