Any great Lakes area near a major river is going to be particularly bad. Besides being a literal toilet brimming with sewage, they have been used as industrial drainage and dumping for 200 years. Keep in mind, the barrier of entry is MUCH lower than the barrier of the actual case. What they are doing is reserving their best (And worst...) ammo until/if the case is accepted and Texas has to file its full case.

Effectively, this is both parties doing the bare minimum to get in, with Texas hoping to prevent them creating any sort of strong argument and the defendants hoping that either SCOTUS refuses to hear it or Texas somehow leaves an opening.
