Technically not unconstitutional. The term "number" does not explicitly refer to citizens. In fact, because Indians who are taxed are consider to be part of the "number", one could make the argument that noncitizens are part of the apportion. Now should they be? That's up for the courts to decide.

Yes, but the noncitizen category includes more than just illegal immigrants (who probably are already covered by using the stolen identity of a citizen). That would also include people like residents and refugees. The Constitution does state that some forms of noncitizens are entitled to be represented in the census, so Biden's incorporation of all noncitizens is not unconstitutional. An amendment or a Supreme Court decision would clarify whether or not that remains the case.
