Now it turns out he was with his fucking dealer before the event happens, a Prosecution witness came out and said it, and the dealer, ALSO a prosecution witness has now invoked the 5th amendment.

He should have told the cops Floyd had taken the whack he was dealing. He could hear floyd claiming to have breathing issues. A major effect of a Fentanyl overdose. The dealer knew he had taken the stuff. He GAVE it to him. And he did not warn the police.

This takes even manslaughter off the table.

Before these three straight days of prosecution shit show, even getting the manslaughter charge was going to be difficult with the police training evidence and lack of life threatening injuries from the autopsy.

Its worse then that. Under the letter of the law the prosecutions own witness committed manslaughter. He gave Floyd the Fentanyl. He was present for the signs of impairment. He claimed to HEAR floyd cry out he was experiencing symptoms of fentanyl overdose. And at no point in this sequence of events, That he, the prosecution's own witness started, said or did anything to correct his action. Establishing the reckless disregard for life necessary for reaching a charge of manslaughter.

It will be more of the same. If the prosecution was going to try and address the drug issue seriously they would not have walked into this. I complained several days ago they were ignoring this at their peril by leaning so hard into the emotional appeal.

They always had statistics running against them. the odds were good one of the jurors would just eat the appeal too emotion up like candy. Unfortunately the odds would also be good one juror would recoil. The balance would be for the other members of the panel.

Now though, the one juror who is recoiling at being emotionally blackmailed is going into tomorrow wanting to know why the emotional blackmailers star witness is pleading the fifth, and if he or she does not get a good answer its table pounding time in the deliberation room. The weak kneed juror besotted on sobbing witnesses will need to find some way to convince the rest of the panel he or she is actually well reasoned in their position and not addled by a brain divorced from reason by tears.

Appeals to emotion only work if appeals to reason dont have a strong vector of attack.
