This really is fascinating. He's completely fixated on trying to prove to the court that the CDA isn't really supposed to protect Kiwi Farms. If these dang dirty courts will just let him explain instead of making him do this busy work of rebutting the arguments put forth in the Motion to Dismiss, they'll find that ackshually the CDA doesn't protect "hate sites" because mockery and satire didn't exist in ye olde dark ages of 1996. He really thinks he has found the One Weird Trick that allows him to circumvent all the rules of evidence, all the statutory limitations, all the procedural requirements.

It's true, though.

Any sensible person with Russ's condition would be fine with written arguments because it levels the playing field for them. They don't run the risk of being misunderstood or being off-putting to a judge or jury (rightly or wrongly, fairly or unfairly, that's a reality of their condition). If one were to offer accommodations to offset this disability, offering to do things strictly through written documents would be a good first step.

Russ, of course, doesn't see it this way. If only he could show what a sad, bullied, but plucky little hero he is, the judge's heart would melt and he'd be offered a win just for showing up. That's how it's always worked, I suppose. It's not just that he uses his disability as a get out of jail free card (literally) he's learned to leverage it into an asset in a lot of cases, whether it's guilt-tripping the Erikas of the world or striking pity into the heart of authority figures. And if that doesn't work, then he can just call them "bias," and dismiss them, which is something he couldn't do unless they saw his disability to be "bias" against.

This isn't news, of course. It's just yet another example of his slimy MO.

I hope he doesn't get his way on this mostly because I suspect it would cost Null more money, but ye gods would it be funny to watch.

Edit: I think it's improper. DUCiv.R. 7.1(f) requires "good cause" which Russel has not shown(imo), and failure of that can lead to the motion being dismissed (Spahr v. FERBER RESORTS, LLC, 686 F. Supp. 2d 1214 (D. Utah 2010))
Russ might be jumping the gun here actually. I think Nool gets to respond to his response to the MTD. The time is not yet ripe for a hearing on it.

And yeah he's not going to get a hearing. But I almost wish he would. Because zoom. And awesome. I'll take a rainbow but a hearing would be magnificent.

I'm sure the court will decide on its own if it has any need to listen to the ramblings of a pipsqueak whose legal arguments aren't worth the paper they are written on. I would love to hear 'yes' but I am not optimistic.

What is Russ thinking? Does he really expect to out-argue an expert lawyer who has probably spent thousands of hours of his life in courtrooms? Does Russ think he’s the real-life incarnation of Phoenix Wright, Atticus Finch and Perry Mason combined? Why am I even bothering to ask, of course he does.

EDIT: He actually wants to try to argue that the CDA wasn't intended to apply to Kiwi Farms. He insists that it's one of the "issues that face the Court" when there is absolutely no basis for that. This isn't the time or place to argue the intent of the CDA, and it's irrelevant to the case either way. Slurping and drooling in front of the judge isn't going to make a difference.
If I thought Russ were clever, I would imagine he's trying to run up costs since he doesn't have any while Null has to pay a lawyer. But I think you're right, he really is stupid enough to think he'll win if he gets to step into a hearing and wow everyone with his shitty suit.

Isn't that what every single 80's feel good movie taught us? That the plucky underdog always wins in the end by just showing up, giving an impassioned speech, everybody starts clapping and the Homecoming Queen suddenly jumps his bones? This is what Pipsqueak thinks the world is all about. But he forgot one key element of this other than the fact that life isn't like the movies.

He can't make an impassioned speech to save his life. The judge will not understand his mushmouthed words and just rule against him because he's being a nuisance.

It doesn't seem to ever occur to Russ that he might lose or, if he does, suffer consequences to his actions.

He probably think he's got a good thing going- spend all of his money on his ego and then plead indigence to avoid having to actually pay for his court escapades.

You'd think a brilliant legal mind like his would have realized by now that that's not how the law works. You'd think that being put on probation and having to pay court costs would have taught him to be a little more careful. But then Pipsqueak is a... special kind of retard.
 
He says he's not making fun of these people but he's certainly belittling them. He's also once again bitter that people hold his own words and actions against him. But most of all, he's exhausted and tired by not getting fame and recognition for his work that he thinks he deserves. That's what he's really upset about. He's angry that other people than him are getting the fame he feels he deserves. Because in his mind, that's the only reason to do any of this. There's no passion, it's all just for the endgoal of fame, money and sex.

I do find it rather ironic that he so constantly complains about how much he hates the entertainment industry, yet tries so hard to get into it. He seems to believe that looks and fame are all that matter in this world, (and to some extent they do matter, but that's not 100% of it) but rather than want to change that he wants to succeed in that world. He wants to be a good looking, famous person in a world where that's all that matters. It's like he's a peasant in a medieval kingdom and rather than wish for a more egalitarian system he just wants to fuck a noblewoman and live in a castle while the other peasants toil away.

And to top it all off, while I'm sure he'll be back, he says he's taking a big step in his "career" as a songwriter by... deleting the only social media page he regularly uses for his music. Great idea, Russ. If there's anything he's good at, it's writing about how simultaneously great and opressed he is. His whole message is about how life is so hard because people don't want to help make him famous.

While waiting for the next chimpout, I read through these messages again and I'm still amazed at his thought processes. If I did a shot for every time he said he's a great guy/nice/the best, I would need to have my stomach pumped.

It's why he launched (and lost) six celebrity lolsuits. I'm referring to the Eirika trial, when he wanted to reject the plea deal and argue his case in front of a judge, and was instead forced by his parents to take the plea deal. Will he be allowed to take this case to court, or will he be saved from his own stupidity once again?
