Got a question for the Americans here, is there a length of time you have to be married for before you're entitled to half in a divorce in his state? Because I'm wracking my brain trying to figure out why she married him. A known cheat marrying a known liar who despite what he says is doing quite well for himself. I know why I think she married him.

It's not about how long you're together. Different states have different laws but a common point in all of them is assets and debts that were acquired before the marriage are the property or problem of the person that acquired them. In other words Kat can never take his house or his car unless her name is on them. You can always add someone's name to a home deed or auto title once you're married if you want but it's not automatic through marriage.

Interesting legal question on that front:

• DSP was due to make estimated tax payments for each quarter of 2018 and didn't do it (April 18, 2018, June 15, 2018, September 17, 2018, and January 15, 2019)
• DSP iss due to make an estimated tax payment for the first quarter of 2019 and won't do it (April 15, 2019)
• DSP needs to have paid in full his taxes by April 15, 2019
• DSP will engage the IRS in a payment plan on April 15, 2019

The IRS calculates interest on estimated payments starting the date the estimated payment was due (April 18, 2018, June 15, 2018, September 17, 2018, and January 15, 2019), NOT the tax filing and payment deadline (April 15, 2019.) It stands to reason that means DSP's 2018 tax debt to the IRS began on those dates- which were before the wedding. Kat may be free from obligation to pay DSP's 2018 taxes as a result. If DSP fails to make his ballpark $4K estimated tax payment for the first quarter of 2019 on or before April 15 Kat will likely become liable for that debt if she and DSP file their tax returns jointly next year. Even if he makes his Q1 2019 payment on time the IRS will apply any refunds due on a joint return to the balance of DSP's payment plan so they should do their taxes married filing separately. If they file jointly and the IRS takes any refunds due they can file a supplementary form (Injured Spouse Relief) to try getting it back. The IRS will evaluate how much of the refund is DSP's (most of it because he makes most of the household's money) and how much is Kat's. The amount attributed to Kat will be returned.

Filing jointly doesn’t do as much anymore as it used to. In the last 1-2 years the tax breaks we used to get from filing jointly have disappeared.
