Did I miss where Dan said he was doing this for a 6 months? All I remember is him saying it wasn’t him when Phil tried saying the same thing happened during the interview with side scrollers. I thought the dude said he’s been doing it for like a few weeks or a month or something

It would be Comcast who will be obligated to pursue legal action against the employee to cover their own asses from liability. I would say its far more likely the dude gets prosecuted than not due to the spectacularly retarded trail he left.
Do I think Phil wont go after the dude who did this? No, I dont think he will, because he never does.
I won't power level but I had something somewhat similar happen with a large company and had to call about 5 times and get an estimate but got a decent sized check at the end. No court. Big companies don't want a lawsuit and bad publicity.
Phil probably got a nice credit and is content with what happened(seeing as how he made good money from a no gameplay chair stream). He's too lazy to actually sue or would blow his retainer on hogans.
