I think any reasonable person would rule that the potato won that fight given that it was a potato and most of the fight wasn't in frame.

Phil's potato fight is honestly the perfect summary of Phil's whole life and all his failures. He attempts to look strong and intimidating to scare his "enemies", tries to demonstrate his "strength" by attacking an inanimate object, fails spectacularly at doing any damage to it, then screws up a well-known saying like "have at you." It's just like his whole life distilled and concentrated into one moment in time. Its beautiful.

They are pretty neck and neck in terms of stupidity and incompetence for me. Both situations were Phil trying to prove that he's a badass and someone to be feared, then failing in typical Phil fashion. If he wasn't mentally a child and was capable of an adult's level of reasoning and self-awareness, he'd likely off himself out of sheer embarrassment.

I'm not sure what Oregon law says about filming people in the street, but I'm certain it doesn't allow the subject to cause material damage to the cameraman.
Edit: I found this but it is not explicit about filming people in public spaces:
I guess it is allowed, then, to film people in a demonstration, but this still doesn't imply permission to make such recordings public.
