Pointless Sperg discussed this in the FAQs thread when the charge was announced IIRC. Largely it's down to what the prosecution thinks they can prove and get a conviction. They might suspect rape (and I'd agree) but if Barb's not cooperating, they might not be able to prove it. To convict Chris of incest, you have to prove he fucked her; to convict him of rape, you still have to prove that, but you also have to prove she didn't consent, and that's a lot more difficult.I still do not know one big thing about this whole ordeal: was the relationship consensual or not? Cause if it was not, then it's not incest, it's rape. The judicial system failed miserably then.
In the case it was consensual.... then I believe the "incest" charge was duly unconstitutional, and I don't know why didn't Lawrence v Texas strike down consensual incest bans too.
I believe it was the former and I'd like to see the reasoning of why incest and not rape.
