Five news outlets, including The Seattle Times, will have to comply with a subpoena and give the Seattle Police Department unpublished video and photos from a May 30 racial justice protest that turned violent, a judge ruled Thursday.

King County Superior Court Judge Nelson Lee sided with the Police Department in a morning hearing, ruling that its subpoena was enforceable. He found that the photos and video were critical for an investigation into the alleged arson of SPD vehicles and theft of police guns.

Lee ruled that the SPD had met its burden to overcome the shield law: that the images were “highly material and relevant” and “critical or necessary” to prove an issue that has a compelling public interest for its disclosure. Getting the stolen weapons off the street was one compelling public interest, Lee found.

Second, a subpoena is not working 'in concert with government'; it is a lawful order from a court to produce testimonial or physical evidence for examination by a party in civil or criminal litigation. One can, and usually should, argue that certain subpoenas seek inappropriate or irrelevant information, or that the subpoena should be limited in scope, but to simply say 'we're the media' is garbage. You have no oversight and painfully few legal repercussions for publishing erroneous or outright false information, or, as in this case, SUPPRESSING facts.

Ironically, this is plausible, but why would it put their staff's physical safety at risk? Oh, yeah, because the people they're covering and, frankly, openly supporting, are violent criminals who will in fact fucking attack them if they decide the favorable dick sucking coverage isn't worth the fact the cops are getting all those pictures anyway.

And this supports overcoming the shield law and compelling disclosure, and it is from the mouth of the Times themselves.

Seriously though, I suspect the point here is to rack up another propaganda victory of "Authoritarian Trump regime oppresses the media". They're trying to make mountains out of every molehill they can to gish-gallop the election -- federal police arresting people suspected of federal crimes is now "fascist stormtroopers kidnappings", etc.

Has the media always been terrifying commie propaganda and I only noticed when they upped the frog boiling temperature a bit 2010-2015, or is this a new level of bullshit?

At least in deep blue circles, the propaganda is working wrt "fascist kidnappings". Most people I know are buying it, hook, line, and sinker. These are smart people, people who used to have intelligent critiques of Bush and Obama alike when they shat the bed, with enough of a (lay) understanding of constitutional law that I don't understand how they can get such basic facts wrong. One even actually did leave the country rather than just impotently raging about it on Twitter!

I'm really starting to get scared by how easily controlled they are, and the way they have been programmed to shrug off the cognitive dissonance of their contradictions and contrary facts alike.

In fairness, I'd say there's probably some legitimate concern that the Peaceful Protesters might suddenly become less peaceful to journalists if they provided the police with evidence that led to other Peaceful Protestors being arrested for arson or assault or whatever. Y'know, "snitches get stitches" and all that. Though maybe the Peaceful Protesters should've thought of that before bragging to the journos about all the crimes they've been doing, complete with video evidence.
