But I'm not talking about an overworked, understaffed Public Defender, though admittedly the term "competent" is probably not the right one. Most public defenders are very competent, but generally lacking in resources and time.I might disagree here. The PD is qualified in the law, but he's not a psychologist. It's his job to get the best legal deal for his client, but the court won't expect him to judge his client's mental state beyond a basic level. Last time, all that meant was a cursory psych eval; I don't see the court re-examining his competency this time when they already satisfied themselves.
Chris is a classic example of the type of street person who spends his life alternating between the streets and incarceration in some form or another. He's just not there yet.
