I kind of hate when Canadians try to comment on United States law and judicial system, maybe because they always seem so aggravatingly smug about it even when it's obvious their only familiarity with US laws is television and headlines on the internet.

Not only are there laws regarding defamation in the form of slander and libel, but harassment is also covered with both civil and criminal harassment laws in a state by state basis. The limitations of those laws stem from being able to provide credible evidence that the alleged defamation was damaging to you, or that the harassment served as a real threat to your well being so not every schmuck who yells "LOL FAGS" from his car window is gonna get thrown in prison or fined.

Yet Carol doesn't see how removing those specifications would be a rather dangerous slippery slope to bullshit wastes of resources and trials like Dankula. No wonder Canada's cucked.
The thing is, that jackass from Quebec that got fined 50k should have simply been fined for garden variety harassment. Guy was a jackass and and got what he deserved, however the 'hate crime' aspect is what is troubling. I CAN understand why the court did it though, because there's nothing worse than some jackass trying to get a person to move by being a racist piece of shit. These are the kinds of a-holes that infest La Belle Province. Even people that are normally not opposed to freeze peach will have some measure of schadenfreude when some jackass gets nailed for that kind of supreme assholery.

But, as a :powerlevel: Canajun :powerlevel: myself, I've seen even stupider people than that clamor for more and more restrictions on speech because they're stupid, and the Constitution of Canada does have a little something called the "notwithstanding clause" meaning the guarantee of Free Speech in Canada comes with strings attached, which is sorta how we ended up with hate crimes laws in the first place. And most morons that vote Liberal or left of that, don't realize it's a double-edged sword or are too stupid to care.

He's not out of luck yet, the UK has a supreme court (interestingly, I believe it was kind of forced upon them by the EU. The a subset of the House of Lords used to handle these duties, but there were concerns about a legislative body presiding over trials.)
He would not be going before a panel of entirely Scottish judges this time, so he would likely get a fairer trial.

@Ginger Piglet, @Bloody Horse, you two are British lawyers, right? Can you provide any insight here?

Is there something else going on behind the scenes or something? It's mind blowing how much time and effort the state is putting into crushing a fairly obscure and small time comedian for an off color joke.
The government prosecutors seem to have a bit of an axe to grind and may have made a very dumb call, and now they're trying to hide that fact instead of fessing up to the mistake.
How is it that England sucks so much harder than any of the other UK countries?
This is happening in Scotland, which is kind of legally distinct, sort of like how Louisiana is kind of legally distinct in the US.

As tempting a possible conspiracy would be as a solution....frankly the past 2 years of....well everything, and shit like the past few months of FBI leaks have convinced me beyond all doubt that the establishment woulnt be able to conspire a fucking pizza delivery without burning down their offices and accidentally leaking state secrets to Alex Jones

In this case its far more likely that you have some middle aged/elderly official with obsessively held on views about "decency" and "the evil internet tubes" that Mary fucking Whitehouse would be rolling her eyes at who read in the newspaper that he was an evil nazi puppyrapist and likely had a rage-fueled stroke that such an obviously despicable man would dare to attempt an appeal.

Remember that british judges and government workers and related officials are fucking notorious both in terms of "by jove this filth offends my 18th century sensibilities!" autism and in terms of "if i tell the internet to do something the internet jolly well ought to do it! dont they know i am a judge/government official?!" out of touch cringe.

A resurgent UKIP is a very real thing in the UK now, and with Labour turning to the dumbfuck voting bloc, the UK could be seeing a more American electoral option between right wing (Tories) and even more right wing (UKIP)

UKIP is mostly being coopted by liberalist/alternative media people like Sargon of Akkad who are using it as a meme to troll SJWs into being triggered by a far right party coming back.

Oh and Paul Joseph Watson from InfoWars is there but barely anyone cares because he's the biggest joke thanks to his direct association with Jones and attempts to seem like a rational thinkier.

This is their government realising that they made an absolute mistake by even charging him for a joke, having a trial, and convict him. Unlike the poor sap who was killed in prison for putting a ham in front of a mosque (LMAO), Dank had a lot of spotlight from all over the world and from important voices in politics and media. The government would have looked not only completely authoritarian but like complete ridiculous fools.
