My point was that the English CPS and Police would have thrown this case out for being a waste of money to prosecute when they have more serious "(((hate crimes)))" than this. You could make the case that bringing this to court is in violation of the European Human Rights act (https://en.wikipedia.org/wiki/Article_10_of_the_European_Convention_on_Human_Rights).
It does raise an interesting question in that there doesn't really seem to be a descriptor of what "grossly offensive" means. There's an important concept in English common law that the law actually has to be written, known as nulla poena sine lege. You can't just prosecute for someone offending you unless there is a written and agreed upon statute on what illegal offensiveness is.No you can't, because Article 10 is a pathetic joke that says literally fucking nothing. Condense it down and what does it actually say?
1. Everyone has the right to free speech
2. Unless your government prohibits it
Dankula should bring the case in front of the High court using Article 10 instead of being place in a clearly biased courtroom wanting to make an example out of him.No you can't, because Article 10 is a pathetic joke that says literally fucking nothing. With the reactions in this thread I'm wondering if this post should be in Salt Mine instead![]()
I'm salty.
Christ on a fucking cracker this is a miscarriage
Rather unfortunately in the UK anybody who feels like they're being targeted is perfectly at liberty to bring a legal case against somebody who they feel is committing 'hate speech'. Usually this doesn't get off the ground because most magistrates will view these claims as dubious at best and refuse to hear them unless the perceived victim can prove beyond reasonable doubt that they are being targeted in some way. That being said it only takes one magistrate to be in the right mood to take the case past the initial stages and all of a sudden you blow it way out of proportion. The tabloid media in the country love this shit and will do anything they can to portray innocent people as racist Nazi pigs in order to get a decent story out of it which makes it more likely that a magistrate will convict somebody in order to not be labelled 'soft' by the fucking Sun or the bloody Daily Express. Our entire legal system is fucked from the bottom up.Who decides what is "grossly offensive?"
