That brings to mind another question... will Chris even be considered "mentally retarded" in the eyes of the law? I personally doubt it as Chris is technically on the higher-functioning (as much as that absolutely pains me to say) end of the autism spectrum, but who knows. They will probably assess Chris and label as they see fit.

It would really depend if they have a disability or learning difficulty where it can be shown without a doubt that they can not understand what is happening to them. Usually the procedure would be to have a parent or guardian present to advocate for them along with legal representation if that person chooses. Being a bit strange doesn't qualify you for this, I don't believe you could argue that he has no idea what's happening to him. They can easily prove he can understand what his rights are by going over them and asking him what that means on tape. If he can show he's listening and understanding what they are saying then any defence that he doesn't go out the window.

There are almost no allowances or special considerations for mentally retarded adults in the US criminal justice system.

No. Google Colorado v. Connelly, that was the Supreme Court case which determined the only legitimate basis for dismissing someone's waiver of their Miranda Rights is explicit police coercion, mental deficiency doesn't cut it.

This is it. The fact that he knew better than to straight up tell Null, bought a book about sex with the disabled, etc can all show that he knew what he was doing, and he planned to do it. Even if he raves about Sonichu, that wouldn't prove that he had diminished capacity for that specific crime.

Also- being deemed insane by the justice system is not a "get out of custody" pass. It just means a psych ward can hold him until he's found to no longer be insane. It's not uncommon for a set prison sentence to be shorter than a stay in the loony bin if a person is actually crazy.

More like someone cracking him in the mouth out of sheer annoyance, and him falling and breaking his skull. If he makes it till the trial, he'll likely be sent to a nut house as a condition for parole.

IF he makes it till the trial, that is. I sure hope they keep him segregated.

County is notoriously worse than actual prison, weirdly. They've got less funding, they're overcrowded, and you have otherwise innocent people who got picked up for DWIs or something sharing cells with people who've murdered people.

In my neck of the woods anyway I'd much rather be in a prison like Attica than Rikers Island.
