It's only "pretty decent" to government workers. To everybody else its appallingly bad. Nobody cares if clerks are overworked. The Clerks aren't the ones having to spend an entire years salary to defend themselves against court subsidized autistic retards.
Well, that's government for you, isn't it? They could hire more clerks, and solve this in 15 minutes, but africa and other shitholes need to receive billions of our money. The structure is there, only thing you need is governmental compliance. That, however, is just a dream. Government for the people is like troons without child molestation, it just doesn't happen.

Stebbins v. Google LLC:
The motion repeatedly cites a case between two dear old friends of ours:
Hughes v. Benjamin, 437 F. Supp. 3d 382 (S.D.N.Y. 2020) ........................................................................ passim
Most people here are probably more familiar with the prevailing defendant, Benjamin, who was awarded fees, by his Internet name Sargon of Akkad.

The court can, but rarely does actually act on its own motion, and there are reasons for that. We really don't want free-roving judges traversing the countryside doing things nobody asked for. Google apparently has the motivation to do this, because they have more money than God and because as this idiot keeps suing everyone on their platforms, they invariably get sucked into it as well.

Believe it or not, I've seen far, far worse vexatious litigants than this guy.

I literally was looking at the case name thinking I needed to read it later because haha that's Carl's name. And here we are.

if he can only be declared to be an annoying retard cunt in a single district at a time whats to stop him from continually being an annoying retard cunt in a new district?

Not much until he collects a few of these little rewards and qualifies for a nationwide ban, which very few people manage. Perhaps he should try to speedrun it. Google's problem from this perspective is they're so ubiquitous they probably qualify for general jurisdiction in every District Court in the country including the Northern Mariana Islands and other shit like that.

How often does an actual request to declare a Plaintiff Vexatious cross their desk though. It seems to be one of those things that is rarely granted, but also rarely asked for. And if nothing else Google has very effectively communicated to the Court that the Pro Se In Forma Pauperis moron is an autistic and psychotic nutbag with a long history of lunacy.

Apologies for the retarded question but the legal system rarely works as I assume it does. If Acerthorn is declared vexatious then could this be considered in ongoing cases or would it just affect future cases? I assume they wouldn’t retroactively apply it but could the defendants or judge enter it into consideration?

I don't believe it would put a stop in ongoing cases (bar an order to that effect), but it likely would be used as consideration in considering the merits of the case

I think more important than the outcome of the case might be the media attention it generates. Acerthorn gets away with his shit because he is a nobody.
Now imagine this lawsuit gets into the mainsteam media or some big youtuber does a video on him. Google is a big name and the whole "vexatious litigant" thing is a big deal(right? How rare are those cases in the US?).
This person is made for tabloids, you can find plenty of pictures of him looking disgusting and you can throw the whole "stabbed his dad for bad internet" thing in there aswell. I think this would be the end of Acerthorn, one way or another.

Because unlike Europe where your rights are merely a suggestion, you have a constitutional right to petition the courts for "redress of grievances". See the First Amendment.

Having your rights taken away should be a massive thing.

That said, as Google pointed out, he has been declared one in his home state.
Certainly, you have the right to file a lawsuit in the event you believe you've been wronged, but what about someone who is clearly just filing lawsuits with malicious intent and no real goal of winning based on the facts? And are you saying that you believe ruling someone a vexacious litigant should never happen? If not, then what is your limit?

The fact that I have a right to bear arms doesn't mean I can close my eyes and fire it randomly without consequences. For speech, obscenity laws exists.

I'm sorry if this breaks your illusion of the US Bill of Rights, but there are limits on pretty much all of them. The limits we currently have are mostly cultural and decided by the courts. I'd love it if things were simple, but they simply aren't.

And I've finally realized. He plays the law like the worlds most autistic Magic the Gathering Player. Simply calling it gamesmanship doesn't do it justice.
Worse, he plays like a sweaty tryhard at a friendly local tournament. He's playing super scuffy, thinking he's hot shit. He calls the judge (heh) on every actions his opponents does, and throw a fit when the judge disqualify him for his 5th unsportsmanlike conduit of the night, instead of his opponent who took an approved shortcut to combat.

Still nice to see the court move fast, for once.

Not going to lie, this is the first time a legal document made coffee shoot out of my nose.

It's amazing how google's filing is clean, professional, to the point, filled with citations (wow so many hughes vs benjamin citations!)

And then there's Acerbore who'se filings are a direct assault to your senses, have little to no citations
It's amazing how this exchange happened in december of 2021 between Stabbins and @Enclave Emily prior to debate (which was cancelled) on the DMCA he issued when facing online criticism. HvB.png

And then there's a fact that, according to Stabbins, this and this videos from Creetosis are Fair Use:

but this video from Enclave Emily is not Fair Use (it is reuploaded, but it has previously been taken down)
