At first, I thought Acerthorn made a valid point here, because the judge does not discuss any of the 512(f) claims. But the Court dismissed Acerthorn's claims under the powers granted by the IFP statute, instead of Rule 12. As the Court states: "the Court retains the power to dismiss the case at any time if it determines that the action is frivolous, malicious, or fails to state a claim on which relief may be granted. See 28 U.S.C. § 1915(e)(2)." The Court gave plenty of reasons why the entire action was frivolous, malicious, and failed to state a claim in both cases. All of the claims are dead.
