Generally subpoenas are issued by a party's attorney except in the case of pro se litigants, where the clerk must approve.
The DMCA subpoena also specifically authorizes this procedure, in the very statute the post you're responding to quotes.
well that's scary. A person can file a lame suit and then get a law clerk to ok a subpoena for your personal details without any judicial oversight? That sounds pretty retarded to me.
