Generally issuing such subpoenas is a strictly ministerial act that does not involve an exercise of judicial discretion, but choosing NOT to issue it generally does require such a determination, and any dispute over the subpoena after it is issued generally goes to the judge. I suppose there might be some minor disputes such as over an address or other "scrivener's error" might go to the clerk, but anything about its actual merits is for the judge.
