Someone hasn't been very thorough when reading Anderson v. TikTok. That case was concerned with strict products liability. The defects (strict products liability is concerned with) in Youtube's algorithm cannot birth a defamation liability. Anderson case is completely different. Also, of note, is that Anderson, just as the SCOTUS case it relied on, specifically denounced that it is applying to algorithms where user input has an impact ("Accordingly, the presence or absence of a platform’s standards or preferences that govern an algorithm’s choices may dictate whether the algorithm is expressive speech, as might whether the platform is a passive receptacle of third-party speech . . . that emits what it is fed or whether it only responds to specific user inquiries") That is also a big nail in the coffin for Acerthorn's claim. Thirdly, look at his promotion/algorithm theory which is completely different to the way TikTok operated. Here he guesses that Youtube promoted a video, wherein in Anderson it was clear that the video was promoted. There is also a question (under Acer's theory) of to whom it would have to be promoted for there to be liability, and whether they could be liable when the defamed suffered no observable monetary damage. The first part is unanswerable, and the second is a definite 'no', imo.
In any case, even if all that were not true, and Youtube were liable, the question would turn on whether or not they knew, or had a reason to know, that the video was slanderous. Cubby, Inc. v. Compuserve Inc., 776 F. Supp. 135 (S.D.N.Y. 1991) (presuming, of course, that were Youtube to be liable, the liability would be of one before Section 230 days) Neither of these factors are here.

Is this a commercial use? Yes. Stebbins has a monetized channel and can derive ad revenue off the content.
Does this dilute the market value of the content? Yes. This is reuploading the entire video and creates a direct competitor in the market for the original product.
Gosh, sounds like someone needs to go back to law school and brush up on fair use before they get sued for such flagrant violations of the original creator’s copyright.
