I see what Stabby is planning. Each "song" can be sued for individually so he wants to cram as many songs into each of his shit video's so that he can then sue anyone who reacts to it for copyright infringement 10 times per video for a kool 1.5 million per video.

Courts evaluating a motion for default judgment take the factual allegations of a plaintiff’s complaint as true except as to damages, which must be shown by evidence... Stebbins here seeks statutory damages, which may require an exercise of the Court’s discretion, informed by the nature of the alleged infringement. The purportedly infringing videos are key to Stebbins’s claims, and thus are likely to be important evidence.

The Court will therefore require Stebbins to file copies of any videos at issue that purportedly infringe his copyright, to the extent such copies are available. Stebbins may also wish to file copies of his own videos that Garcia Baz allegedly infringed.

Docket 46 Stebbins has failed to comply with this request in spectacular fashion and instead submitted 207 video exhibits meticulously cutting out anytime Baz criticized Acerthorn in his allegedly infringing video.

I think he submitted the entirety of the video in these little chunks and is just asking for the clips listed to be the ones that are viewable only in the court terminals or whatever the semi-sealed arrangement was.

Notice that I am not including the odd-numbered clips which I have uploaded. As I explain in the First Amended Complaint when I discuss these playlists of clips, the odd-numbered clips are where he provides criticism and commentary. The defendant has the right under the First Amendment to publish this content as long as he isn't making an unfair use infringement on my copyright. So these odd-numbered clips can be made publicly available to the greatest extent possible, and the public can request copies of them from the Clerk's Office if they are so inclined.

I do feel like the court would have rather had the whole unedited video, but that magnanimous turkey goblin (no relation) took it upon himself to split it up into chunks so that the court and Baz can both know which parts should be allowed for reposting.

I do heavily doubt the judge will award Stabby everything he's asking for.

We never seen a judge rule that because of copyright someone has to be banned from a service, I'm pretty sure Google would step in if Stabby presented them with a judgment that tried to force them to permanently ban someone from using their services. Nor will he, as if he could, force Baz to hand over all his computer gear for a 3rd party to inspect and delete shit.

Stabby may get the default judgment but I'd bet my eyeteeth that it won't be for 150K per pop like Stabby is asking. David will have to prove income loss before the judge starts handing out 1.5 million dollar judgments against a no show defendant and good luck showing your videos that make cents per year are worth that kind of payout Stabby.

I kinda want to see a default judgment but one that awards Stabby like $25 bucks because that all his copyrights are worth. I can taste the meltdown from here when Stabby gets news like that. Then he gets hit by Google as a intervene'er when Stabby demands they hit Baz with the banhammer and everything gets tossed out.
