The only problem with that, is despite the service itself being illegal, taking someone's money, and not performing the agreed upon action is fraud.

The best way to do it, in my opinion, without it being fraud, is to offer DDoS, take their money, contact the site the person wanted DDoS on, offer them 60% of the money you were paid for a little voluntary downtime. Then tell the person who paid you that you did your best, but the site is back up due to mitigation. Technically the entire thing is completely legal.
