Both of these things are true, the obvious fix to the BCG problem is to simply use an AR18 or a Daewoo K2 style piston and bolt, Brownell's makes AR18 style uppers for AR15 rifles and if there were more demand for them I'm certain other manufacturers will jump on that band wagon. The answer for the lower is a bit more complex and frankly I'm not a lawyer but building something along the line of the SCR, but sufficiently different to avoid the copyright has to be doable.

EDIT: Now that I think about it piss on the AR15, at that point you may as well just figure out how to make featureless AKs for less than $700 if that's feasible.

They can also assemble them into bolt actions or .22s that the law doesn’t apply to. Ultimately it’s up to local dealers to comply with state and local laws in their transfers and end users to assemble them into complete rifles that are compliant.
