It's possible, a defense lawyer can negotiate the plea deal with prosecution but the defendant still has to actually say they agree to it to the judge. They can always say go fuck yourself to the judge/prosecution at the last second, which of course means their defense lawyer won't trust em anymore and the prosecution will throw the book at em.
