it was for discrimination on the basis of sex, since men don't tend to get banned nearly as often for saying the exact same shit.
It was for "viewpoint discrimination"... discrimination on the basis of "political beliefs and perspectives." Someone's viewpoint, or their political beliefs and perspectives, isn't a protected class.

The lawsuit does claim that Twitter's TOS are unconscionable because they give Twitter the right to ban a user "for any or no reason"... it alleges that Twitter is claiming that it has the right to illegally discriminate on the basis of race or gender, but it fails to prove that Twitter actually did that. This argument generally doesn't hold water either because Twitter's TOS can't give it the right to illegally discriminate, no matter what it says. But Murphy didn't prove that Twitter did illegally discriminate, so no, her lawsuit wasn't about discrimination on the basis of any protected class.

The basis of the lawsuit can be found in its causes of action.

Breach of Contract. Murphy claims that Twitter's TOS establishes a binding contract between herself and Twitter, that Twitter breached it, and that Twitter's breach caused her harm. I'll be honest... this one's pretty pointless. Good luck trying to argue in court that a site has to abide by its own TOS or that you should have any recourse if it doesn't; the court will simply say, "if you don't like it, you don't have to use it." Murphy tries to argue that you can't just not use Twitter, with such arguments as "A candidate without Twitter is a losing candidate," and "a presence on Twitter is essential for an individual to run for office or engage in any level of political organizing in the United States and Canada." Again... it's a really fucking long shot to even try for this.

Promissory Estoppel. Murphy claims that Twitter's TOS provide a number of clear promises: "will not censor user content" (except in specific circumstances, none of which applied), "will notify you 30 days in advance of making effective changes to these Terms that impact the rights or obligations of any party to these Terms," any changes to its terms of service would not be retroactive, "account-level" actions such as permanent suspensions are be used for "egregious" violations of its terms or repeat offenders, "You have the right to express yourself on Twitter if you adhere to these rules," and a sworn statement by Twitter CEO that Twitter doesn't "consider political viewpoints, perspectives, or party affiliation in any of our policies or enforcement decisions, period."

Unfair Competition. Murphy claims that the terms allowing it to ban a user "at any time for any reason" and "without liability to you" are unconscionable, and that by adding those unconscionable phrases, in 2012 and 2016 respectively, Twitter has engaged in unfair competition. Murphy alleges that Twitter's advertisement of its service was fraudulent, as it repeatedly called itself a "free speech" platform, and by using fraudulent claims in its advertisement, Twitter has engaged in unfair competition. Murphy claims that she and others relied on Twitter presenting itself as a "free speech" platform, and invested significant time into creating an account and gathering an audience of followers, which she claims have significant tangible and monetary value, when "no public forum comparable" would allow her to reach so many followers.

Murphy asked the court to issue an injunction ordering Twitter to cease and desist enforcement of any changes in its TOS that were made without the requisite 30 days notice; cease and desist retroactively enforcing rules; restore any users that it had banned under such rules (such as its "misgendering" rule, which was added to its terms without notice and then retroactively applied to her); remove the unconscionable terms from its TOS; and publicly apologize and basically admit that they're lying sacks of shit who don't believe in free speech. She also asked for declaratory judgement stating that Twitter had breached its contract and violated California's Unfair Competition Law, as well as asking for costs, fees, and any and all other relief that the court deemed just and proper.

There are natively available programs for every single OS and CPU architecture combination under the sun that have the ability to strip out all EXIF data from a picture. This isn't rocket science.
BTW: Windows does not remove all metadata when you use its metadata editor tool that it built into Explorer. ExifToolGUI is effective, though it is a huge piece of shit. I think I verified that ExifEraser for Android is effective.
 
Disappointing, but I'm not surprised. Trans politics are extremely conservative (pro-censorship, anti-woman, anti-gay), the government/the courts are very conservative as well, and Twitter is really conservative in its social views and how it determines what's banworthy. I was just reading a story about two girls trying to escape forced marriage in Saudi Arabia and Twitter, at the behest of the Saudi Arabian government, deleted their accounts so they couldn't speak out about it or receive help. So like.. to recap: Hate speech against women, gays and people of color, advocating conversion therapy for gays, and rape/death threats against feminist women is okay with Twitter, but god forbid you tell a man in a dress that he's a man in a dress or speak out against or try to escape an oppressive, conservative, religious state that is forcing you into lifelong rape and oppression, that's bad and Twitter will ban you for it.

It's kind of.. funny, in a depressing way, how obvious they are about their priorities.

Not surprising that they'd shut down a Saudi Arabian shitstorm given that Saudi Prince Alwaleed Bin Talal owns more of Twitter than Jack Dorsey. Maybe they've got another shareholder who really loves troons or something?

afaik a ton of their staff are troons. There was one a while back, a trans Twitter engineer who raped his wife, I forget his name. Lots of troons on Twitter brag about how they'll get their buddies who work for the company to silence anyone they don't like.
 
If you happen to have Photoshop you can remove EXIF data by saving the image for "web & devices."
If you have GNU Image Manipulation Program ("GIMP"), you can Export As, save as JPEG, and then expand Advanced Options and turn off the option to save EXIF, XMP, and IPTC data.

If all you have is Microsoft Paint, you can remove metadata by opening the JPEG, saving it as PNG, and then saving it as JPEG. Either the PNG or JPEG you save-as won't have any metadata in it. Saving as PNG is necessary though; that's the step that removes the metadata because the PNG file can't include it.

Of these two, using Paint will probably degrade the quality of the JPEG a little more, but probably nothing you'd notice, so it's not like you'll care.

Gee, I never saw that coming...

To all the TERFs on this forum who tagged my posts as "autistic" for saying she was going to lose: don't go around shouting how you're about "women's rights" when you don't even understand the law. Anyone passingly familiar with these lawsuits against social media companies could have told you she was going to lose.

How many people are using a public tampon/pad dispenser? At a school nonetheless? Can't be enough to warrant the $350k much less an additional $700k for one in the men's room and one in a gender neutral single stall bathroom.

Also...wouldn't a transman (theoretically speaking) be on hormone blockers and or male hormones and thus not get their period? So who is in the men's room getting their period??

There are many, many straight women parading around these days calling themselves "trans men" without ever taking testosterone (and I think it takes a while for testosterone to stop the period completely anyway), just like there are a whole slew of troons who will never take estrogen. Those women all have periods, but I seriously doubt a single one of them would ever use the men's bathroom out of (rightful) fear of male violence. Patterns show that most trans-identified females prefer to use the women's bathroom, regardless of hormone status, just like they prefer to be on women's sports teams and women's prisons. It's one of the many ways the trans-identified male platform of "everyone should use facilities/services matching their gender identity" screws things up for females who actually are at risk of violence, rape and death should they try to force themselves into male spaces.

Anyway, yeah, I don't think anybody uses those dispensers anyway. Every one I've seen has had shit quality products that could be one-upped by loads of toilet paper lol. I've never seen a single woman ever use one.
