That'd hand it to the conservatives though. The current split is 4/1/4 with Roberts being the 1. With him gone and Ginsburg gone it is 4/3, clear conservative majority.

See this is the problem with Democrats and the left in general. They are stuck in the past. They expect Republicans to fall over and stick to things they said in the past. They still believe that the people in power in the GOP are bound by evangelical morals, despite almost four years of being led by an adulterous, sinful casino owner. They have been using a playbook that's old enough to vote, not realizing that the ground beneath them has been shifting the entire time. The movers and shakers of the GOP have been using the same horseshit that the Democrats have been pulling for decades all while the media and hate machine focuses on the President. How many judges have been confirmed? Mitch McConnell is going to bend the DNC over and fuck them in the ass, and they deserve every fucking bit of it.

You may have had a point, six months ago before Democrats just dropped the act entirely and tried to run the country into the ground. Kavanaugh is 55 years old, if he stays as long as Ginsberg that's over three decades of hearing cases. this entire situation could have been easily avoided and they could have had whatever Justice they chose sitting on the bench for a good 30+ years if they'd done it when the Democrats controlled both the House and the Senate.
I have a proposal. If you reach a certain tenure or age, you have to GTFO. NO exceptions.

Oh, well, that explains it. my above made me realize something, this actually IS fucked for the democrats. They were probably hoping on Roberts being a complete idiot, he likes to kow tow to the left to a mild degree, and give them a chance in the supreme court with a contention. But the head justice recuses in the case of a hung supreme court. That means the CONSERVATIVES have a clear majority on the Supreme Court in the case of election contention.
 
She said that earlier today, before RBG died, and as far as I know she was not aware of RBG's decline in the last few days. So I wouldn't put her in the confirmed category yet, as that may have been political positioning done under the reasonable assumption that RBG would live another couple months at least.
 
Remember that Democrats have been normalizing the notion of packing the court or adding ways to force Justices from office for the last 4 years. They can still spin her being replaced into a pro-turnout issue.
True, but that road is far bumpier and uncertain than a Justice confirmation- which by legislative standards is relatively smooth sailing (or as smooth as procedures can try to be).

if it’s 4-4 and Roberts Recuses himself, Trump wins. Technically right now there are 3 Leftist Justices and 5 Conservatives, assuming Roberts doesn’t go soft. More troubling is in the event of a tie, the lower court ruling stands. So expect lots of shopping of venue, trying to get it to the DC Circuit,
