I'm confused about something. Does Len think if he can somehow prove the train was speeding that day, he'll be off the hook for trespassing and reckless endangerment?
It's the childish defense of "forget what I was doing, you're so much worse! Nananana boo boo!"
He may think it's a zero sum game where either he is guilty or the railroad place is guilty; he doesn't understand that differing crimes will have differing sentences/treatment. The best he could hope for is for the railroad to also get in trouble (which it won't), he has no hope of getting rid of his own crimes. Alternatively, he may be attempting to "take them down with him".
