He's been "released" from the corrections system. That doesn't mean the big gates opened and out he waddled. He's now in some sort of program or halfway house type of situation as part of the autism deferral.
Most likely, he'll probably be there until August when the next court date is scheduled.

Since he's just been in jail awaiting trial he's still recieving his tugboat. Lord knows why someone who's already being taken care of and fed in jail needs it.
After a certain amount in jail your SSI/SSDI is cut off and has to be reinstated. He went far past that amount of time. He is not going to come out to some huge backlog. Now he probably would have worked on reinstatement if he was going to a group home/boarding home since that money would be what pays his room and board.

"What happens to my benefits when I am in prison?

If you receive Social Security, we’ll suspend your benefits if you’re convicted of a criminal offense and sentenced to jail or prison for more than 30 continuous days. We can reinstate your benefits starting with the month following the month of your release.

If you’re receiving SSI, we’ll suspend your payments while you’re in prison. Your payments can start again in the month you’re released. However, if your confinement lasts for 12 consecutive months or longer, we’ll terminate your eligibility for SSI payments and you must file a new application after your release. "

" According to SSA, “We cannot pay benefits to someone who, by court order, is confined in an institution at public expense in connection with a criminal case if the court finds that the person is: guilty, but insane; not guilty of such an offense by reason of insanity or similar factors (such as a mental disease); or incompetent to stand trial for such an alleged offense."

"The Privacy Rule permits a covered hospital or other covered health care provider to maintain in a directory certain information about patients – patient name, location in the facility, health condition expressed in general terms that does not communicate specific medical information about the individual, and religious affiliation."
A lot of facilities have higher standards than required even by HIPAA and it's particularly common for psychiatric facilities to refuse to disclose anything at all they are not specifically obligated to disclose, because the mere fact of something being a psychiatric facility itself communicates fairly specific medical information.

I also wouldn't be surprised if Heilberg didn't try to get even a non-HIPAA covered entity to keep Chris under wraps.

We've kind of gone over this over and over again, but, from the SSA website:

Wait, where is he getting money? He was broke before he went in. The government doesn't give you money as you're leaving. He would just be issued his clothes and sent on his way.

Worse than that. A lot of places actually charge you rent for the time you’re in jail. I’m not sure if VA is one of the places that does that, but Chris could wind up with even more debt getting out. That is besides the fact that he probably has court fees and maybe fines to pay.

Anyone know what happens to his tugboat while he’s behind bars? If it’s still going, being forced to save money might be the best thing for Chris, but if that just means he has more debt, he won’t come out ahead.

Virginia doesn't allow more than $3 a day for inmate rent if they charge it, and so far as I know, CVRJ doesn't. The Virginia DOC even has reentry assistance programs for released inmates including assistance with housing for some:

Also unless Chris seriously screwed something up, the tugboat didn't stop so he probably does in fact have a nice fat lump sum right now. Whether he can go immediately blow it on Lego or whether his tard wrangle gets to be a designated payee and make sure he doesn't fuck up, I don't know.

If he's in some kind of custodial psych facility, that also could terminate the tugboat though.

Rather than go into that at great length, here's the general rules from the SSA site (you can check the FAQ thread @Pointless Sperg started for a lot of in-depth analysis):

My theory is that Chris Chan died. Idk why but its what I am going with.

I should think we would know if that happened. Especially if he died in jail.

It would be illegal to say the least for the courts to claim he is released on court order or bailed, had he died.

If he had died and they covered it up, it would be insanely pointless as it would be career ending for so many involved professionals, just to keep some internet weirdos from finding out.

It makes more sense in contexts other than Chris. The first thing to remember is that Chris wasn't convicted of a crime yet, they don't take away your SSDI income just because you got accused of a crime. Lots of families rely on SSDI income, if Chris was supporting his mom or some kids they'd have no income while he was awaiting trial.

Remember chris has thousands of dollars of tugboat checks from his many months in jail. Rather then live responsibly like paying off credit card debt or attempt to pay off the sonichu temple chris is gunna blow all his money.

Probably a new laptop, new Nintendo switch, new tv, transformers, Legos, mlp swag, maybe even a few appointments with "Mia Hamm"

Actually there is a second clause related to that:

" According to SSA, “We cannot pay benefits to someone who, by court order, is confined in an institution at public expense in connection with a criminal case if the court finds that the person is: guilty, but insane; not guilty of such an offense by reason of insanity or similar factors (such as a mental disease); or incompetent to stand trial for such an alleged offense."

So if this entire time was related to him being incapable of standing trial that still counts as his benefits being stopped.

The fact hes in jail is enough to stop the benefits after 30 days for SSI/SSDI, regardless of conviction.

The epo was only a temporary restraining order and since he's not being charged with rape I don't see any reason the court would do that. Barb could have filed for a restraining order against him but I don't know if those records are public.
He has not been declarred innocent. He has been bonded out pending trial. The Judge can and will attach conditions. You can be assured "No contact with Barb" would be top of the list. 14BC will only be accesible to retrieve personal property with Sheriff's escort. Because that's how its done.

We don't actually know the charges because most of this is under seal. Which would be expected when a retarded asshole fucks his elderly declining mother. The seal is for the victims benefit most of all.

No Internet or carefully managed internet could simply be the rules of the facility he has been sent to.

Yes if he had children or a spouse they would not stop benefits its the fact hes the sole beneficary that makes them stop.

If you'll recall in recent praetor interview (that correctly predicted chris' release) they claim chris was receiving all his monthly tugboat checks via direct deposit to his bank.

Chris is gunna have more money at one time then he's ever had in his life.

I wouldn't be surprised if he went into game stop and tried to reenact the sonic says shopping spree

Had not known about this that is not common practice. Kind of screwed up that some of the schizos where I work HAVE lost benefits when incompentent to stand trial barely jailed for over 30 days for far less crimes then what he did to his mother.

I know we don’t know his bail conditions, if any, but I am guessing absconding South of the border will be a huge problem legally long term.
Going south of the border is how he got here in the first place.

I'm not sure how the autism deferral works since it's a guilty plea. Chris basically said "Yes, I did it, but I'm retarded". Technically then, the payments should have stopped when Chris's lawyer filed for that, however....

...Chris's tugboat most likely stopped very early on when he was shipped off to Western State Hospital. Involuntary commitment is one of the mechanisms for it getting shut off.

However! Chris could reapply and get them going again. So possibly his lawyer helped him to do that, but with the "Guilty, but tarded" plea he gave the courts on the Class 5 Felony Incest charge, it may have stopped back in July/August.
