It's actually a pretty interesting question. If you recall the context of Ethan's false pedophilia accusation against Matt Vickers and his wife, Vickers and Ethan were streaming at the same time to their own audiences. When it became known to Ethan that Vickers was streaming and discussing the cases, Ethan sniped Vickers. Naturally, Vickers' chat noticed this almost immediately and brought it to Vickers' attention, and Vickers sniped Ethan back. Vickers and Ethan began cross-talk via their own streams, and at some point Vickers made a comment about Amanda (not a party to Vickers' RO) being a pedophile. It is at this point that Ethan claimed that Vickers (party to Vickers' RO) and his wife (party to Vickers' RO) were the actual pedophiles.

Ethan pretty quickly realized that this statement was a big mistake, especially given that he was due in court that very week for violating that very restraining order, and ended his snipe almost right away. Once he ended the snipe, he immediately began trying to backpedal his statement in a very flustered manner. In the process of doing so, he stated that he did not actually know that Vickers and his wife were pedophiles, and that they might just be pedophilia advocates for facilitating the Izaiah situation.

That leaves us in a pretty nuanced situation regarding the actual malice issue. For anyone not familiar with the concept of actual malice, the standard is outlined in New York Times Co v. Sullivan and is defined as a statement made “with knowledge that it was false or with reckless disregard of whether it was false or not” (source). Does Ethan's admission that he called Vickers and his wife pedophiles without having reason to believe it was true constitute a knowing falsehood or reckless disregard for the truth? Does him walking it back on his own show constitute a retraction even though he knowingly made the statement to Vickers' audience as well as his own, then walked it back only to his own audience? I certainly can't say for sure, and it seems like the sort of thing where a judge will need to weigh in.
