Its possible to convince a judge to show mercy or to sentencing to less than the recommendations. But in this case, it seems to have been the opposite. The report was so bad that everyone moved to a harsher sentence than would be expected. That is kind of unusual to say the least. The judge additionally sending Nick to sociopath school - possibly beyond the report's recommendations - is also really telling.
